The time is soon upon the adult Internet industry where companies will be fighting for their lives, and their owners will be fighting for their freedom. Attorneys and other industry leaders will have little time to write articles and give speeches, to provide the industry with the benefit of our experiences. Instead, we'll be fighting in courtrooms across the country and endlessly toiling away on legal briefs and motions, in the effort to ward off the new wave of government censorship. It is this author's sincere hope that those selected for obscenity prosecution will stand and fight, and that other industry participants will support those defendants in their efforts. Tammy and Herbert Robinson stood and fought, and their "Notice of Dismissal" hangs on this author's wall as an eternal reminder of their courage and vigilance. Their actions should truly be an inspiration to an industry under siege. If the defendants in the next round of cases show the same courage and tenacity, the government is likely to rethink the wisdom of its censorship campaign.

Where most people blunder right off the bat is taking a hostile posture towards the prosecutors, US Attorney, AG, or whoever it is coming after you.

Deal with them respectfully, professionally, and with extreme deference and in many cases you can work deals to get yourself out of it without much hassle or legal expense.

I had an obscenity situation years ago when the phone sex industry started and we were one of the largest and most visible players. At the time there were no applicable statutes yet written pertaining to telephonically distributed pornography so there wasn't much guidance for the first companies to go by.

Anyway a state AG set his sights on us and we dealt with it head on, but in a very tactical manner, and we ended up getting out of it completely with minimal legal costs, and no hassles thereafter.

When you go in with boxing gloves on you're going to get a fight and most times its not a pretty picture when its over. Go in and negotiate a deal with your mind and words and you can get a win-win for both sides and walk away with your money intact and nothing on your record.

Most of the industry lawyers are like car sales people. They continue to try to convince all of us that we are in deep deep shit... but that THEY can save us.

If they had nothing to sell I would believe them... but they do have something to sell, so I dont.

This is great advice. People should learn from it. I promise you more people have gotten themselves into trouble from having a chip on their shoulder then for their pornographic exploits.

Same goes for dealing with cops....

Amen to this as well. Not sure who the huckester who was across from my booth in Florida. But this cat jumped me early and went on how I am at risk, and he can take care fo everything, I need to put him on retainer....

I was like I am a MORON, back off.... I hate attorneys.... Which is a true statement!
