Private Sues BoneProne, 'Porn Mafia Family' for Infringement

PORTLAND, Ore.—Iowa-incorporated and located Fraserside IP, a Private Media Group subsidiary, filed a copyright and trademark infringement lawsuit in U.S. District Court in Portland, Ore., on Friday, alleging 126 known instances of infringement of its content by BoneProne.com and the so-called "Porn Mafia Family," using a bevy of alleged aliases.

The lawsuit is Fraserside IP v. Jones. The websites used to perpetrate the alleged infringement are also named defendants under these DBAs: BoneProne.com, TubeKings.com and SoCalMovies.com. People named are the abovementioned William Michael Jones, aka Michael Jones, aka Mike Jones, aka Mike Bone, aka BoneProne; and Mindy Jones, aka Mindy Jacobs, aka Queen BoneProne, aka “Porn Mafia Family." Other defendants include La Vista, a Philippines entity; Chin Holdings China, a Panama entity; Marvin Greencarrier; and John Does 1-100 and John Doe Companies 1–100.

The 60-page complaint—which was filed by local attorney Lake Perriguey and Fraserside attorney Chad Belville, who has requested leave to appear pro hac vice before the Oregon court—tells a sadly familiar narrative of infringing activity perpetrated on a large scale through the intentional creation and use of a sophisticated business model whose sole intent is to "capitalize on the illegal dissemination and contribute to the illegal dissemination of infringing works." It also paints a portrait of a digital universe unable to stay technically apace with infringers.

You may not be "hosting it" but you displaying it on your site. Seems like it's going to be an easy case to win. Even if BP could win it some how he is still going to lose from the legal costs.

Funny, on GFY BP starts running his mouth that he is going to show them and that he is poor and don't own anything. Amazing how fast someone goes from bragging about riches to poor mouthing in a matter of minutes. I am sure the courts will figure out his net worth. He also claimed he didn;t make any money from those sites. Don't think it really matters if he made a lot of money from the sites or not. They still going to try to take the money you made from other stuff and you still going to be liable whether you made a lot of money or not from their content.

I have to say that this has been a long time coming, shocked that it hasn't happened sooner.

However, I think this case still has some legal pitfalls and issues to look at. The real question will be "is embedding publishing?". I think the answer is yes, because it's the site owner that chooses to embed or not, no different from choosing to put an image in a newspaper or magazine without permission.

Clearly, a site who's motto is "free full length porn movies" fully intends to violate copyright and use material without permission. Further, because they clearly admit that they have the power to remove stuff from their site:

For me it's open shut, no question he is going to lose. The defense of " it's not hosted on my server" isn't going to matter to every day people (on a jury). The fact of "where" it is hosted isn't going to matter, where it is displayed and where people can see it will matter... and that is on HIS site. If it was CP videos he was embedding would he go to jail (yes). If it was obscene videos could he be prosecuted ? (yes) It will be no different in a civil trial.

The only way that he would have a chance is if he was embedding from a clean site like youtube and it just so happened someone uploaded a stolen video on youtube, which then showed up on his site and he got sued for it. Then there would be mitigating factors that could come into play like a lack of intent. But when you embed videos from sites that EVERYONE knows is full of stolen content then you, yourself are trying to display and profit from stolen content on your site.

The other thing that is stupid is the people saying that this is an attack on embedding, or they wont be able to embed content any more. Which isn't true. If you embed videos with content that is approved from sponsors, do not allow user uploads, or actively monitor their site and remove any stolen content then you will have no problems.
