The rash of fear tatics is upon us! A lot of you have said you cant afford to support IMPA et al...so does that mean your going to continue to support those companies that have rolled over on you and the rest of the industry for a "sweetheart" deal? Lets see hear what your thinking!

ahem, I have discussed this with Gonzo over ICQ and here is how i feel about it, agree disagree with me, it matters not, and you will see why.
I will not do/will not have any business with anyone who has settled with Acacia. This is a personal descision. I would point the fact out to anyone I know who is about to/thinking about doing business with these companies, that they have signed a deal with Acacia, and quite possibly
possibly given out personal information about their affiliates to the lawyers of Acacia. I would encourage someone to think about what that means to them personally, and what it says about the company they are considering doing business with. I would promote the use of a verifiable list of names that shows exactly who signed with Acacia, as this should be a matter of public record, and if they signed, they should not be ashamed/afraid to let the world know of their wise business descisions.
Now, as for this shit;

I have read his posts there, and he says 80%, hows it feel to be in the majority of something?
Originally posted by spazlabz@Oct 25 2003, 08:26 PM I will not do/will not have any business with anyone who has settled with Acacia.
People have to do what's in the best interest of their companies, and if you can't understand that, chances are they don't want your business anyway cause you probably won't be around too long.
As for the personal information nonsense everyone is bitching about.
People are making a mountain out of an anthill.
Whether their came from a sponor, content provider, whois, or random names from the fucking phone book, it matters not. Go to PK or any other link list, tgp, mgp, search engine, grab a list and run a batch whois.. viola! thousands of porn webmasters to send a pretty letter to.
If you own a single domain, there are a hundred places to get your name and address from, and the tools tossing off the "i only used my onfo once" line.. are obviously as dumb as they come across by saying something so stupid.

I have been around 4 years, humm, not as long as some, but far longer than a lot of others.

How would you describe every acacia related thread posted here?

and if Acacia wants to do whois on sites owners it is well within their right, aparently YOU enjoy posting but not reading, webmasters who have nothing to do with anything even remotely covered by the alledged patents are receiving "Final Notice's"
I got one.
Haven't had a site with videos on it in probably close to two years.
Quote:
I can't tell if your an Acacia Employee, an aplogist, or just
stupid
None of the above.
Just a little tired of people and their bullshit conspiracy theories, half assed detective work, and... wait for it....... specualtion, when 90% of the settlers have yet to be named.
I'd be more worried about those guys then the ones we know settled.

So the truth hurts, who are you? what business do you run? Oh, ya won't say because indeed, in this instance, the truth about you really would hurt.
It doesn't matter, I got a letter, I do business with people who got the letters, I do business with people that have settled.
None of which will change.
The Truth Hurts - until you show substantiated evidence that you are in this business you're nothing but a whisper lost in the wind trying to be heard
Haven't seen you have many positive things to say so my guess is you may be a newbie who got in too late or something that didn't have the ability to make it or you're just a porn surfer wannabe who accidentally stumbled onto adult webmaster chat boards
as for your statement eat your ass ..... you have none, nor any balls or guts
Put up ........
Who and what are you
if you wish to give your opinions any credence
otherwise you're less than dust in the wind

If it weren't for the handing out of personal information which I'm against in nearly any situation, this wouldn't really be such an issue for me.
I can understand not having the money for an expensive patent lawyer and thinking it's either do this, or pay *huge* fines for past "infringement" over the years. Imagine the amateurs who are getting letters. I always tend to think of them first whenever something comes down that will "affect" the industry.
Some of these people really *do* feel that this is the best decision for their business, especially if it gets rid of past fines and if they can probably skip the $1500 too. And then if the patents are invalidated... cool. It's all over. But if the patents aren't, they're not facing a massive bill of thousands upon thousands of dollars that they don't have.
I can understand that.
I know the companies like CECash wouldn't have to worry about a few thousand dollars - but in the same vein, they'd have to worry about *millions* of dollars. Just as they're larger, the fines would be larger.
It's covering your ass, and that's one thing I always chant... CYA, baby.
However, I just cannot understand nor support giving out information that you've been entrusted with. The companies that did this - just how much info did they hand over? Their entire database, including social security numbers and EINs? The amounts that each webmaster has been paid? The exact number of videos/photo sets that each webmaster purchased? Or was it *only* names and addresses? Doesn't really matter to me - it's a breach of trust.
If they *did* hand over complete databases with SS#'s and EINs then I think that might violate some right to privacy somewhere - god I would hope so, at least.
I don't need any of the companies listed on my Acacia letter. I don't send traffic to them anyway for my own personal reasons.
It's the ones that *aren't* listed on the letter that have me wondering.

Or maybe its your boss Mr. Mormon Lew Payne....posting LIVE and in color from Idaho? Really doesnt matter cuz I can answer both of you..[split personalities or not] here and now.
For the record...Confucy...I wont bother running up the page views on your hideaway baybeeeee. Im like Kevin and KK...if you want to address me you can do it on Oprano. Just remember when your over there making your secret dirty plans with TDipshit my goodie bag is always open.
Since you really dont have any sites...unless you count Lew's as your own it really doesnt matter what you think. But I bet I dont have to look far in a recent thread where your deflection tactic tried to engage us all on this issue of this lawsuit. I guess it was one of your cats posting?
And Lew if you decided to put down your Book of Mormon to join us greetings. Glad you could make it over instead of hanging out on Amazon and reviewing Kevin's book. Are you jealous that Ive got an autographed copy and you dont? Poor baybeee!
Last time I checked your stats on some of your sites...it looked like there was video on them. Ya know for a Master Hacker your not to sophisticated when a fat fucking nobody can go digging around. You and Beth should really get a handle on Jackie. You might want to do it before next week though. Check Expedia to see how much a flight is from Idaho to Marina Del Rey...
You might want to use your super hacker skills to look at the legalities though. The way I read it...it applies to link lists too as well as TGPs!
Best check that mail box in Panama!
Im so glad to see that you are both bored on a Sat night. Im sorry I couldnt get back with you faster. You see I was out at alarge dinner party at Morton's spending my new and extreme salary from Oprano. You know its massive since Serge and Mike had them extra long puppet string attached to me to reach to Tampa.
Bad form Confucy to hide under Lee's skirt. But Im sure she enjoys it just the same. And Lew...Kevin is right...you are the chicken shit one!

But... Truth hurts is not Confucy... at least, I really don't think so....
Truth has been around here for at least a few months.....
anyway....
let me preface this with "I have not gotten a letter" so I am not in a position of taking any action of any kind yet, at least other than to throw what support and research I can....
But, I would encourage anyone that gets a letter that does NOT have a site with video to take action against the letter...
Not sure what kind is the most appropriate and that would be for each individual and their lawyer to decide....
The types of action I am thinking about are:
1. Report them to the postal authorities for utilizing the US mail for what most certainly looks/feels/sounds like extortion.
2. Contact the FTC and report them for unfair business practices.
3. Call them on the phone on your dime, make the call a nice long one, use the most expensive long distance provider you can find... Then ask them to reimburse you for the call, when they say no, hit them with an invoice for it, when they fail to pay it, file in small claims court against them....
Make them fight on as many different fronta against as many different people in as many different venues as possible....
There is every possibillity that this patent can/will be validated....
From what I am seeing, the easiest way to beat them will be to prove that the patent is unenforceable, not necessarilly invalid....
anyway, all of that is strictly in my humble opinion.......

Thanks...I dont know I got a copy of the post in my email so I didnt try the link. Like I said...Ill address Jackie here on Oprano. Shed better rest up though...she gonna be plenty busy in a few days.
I wonder how much a ticket from Miami is to Marina Del Rey?
To this date I havent gotten a packet either. Of course I wasnt signed up for Matrix Content either.
Turth,Microchick...hell the woman has identities to match her multiple personalities and social security numbers. Im waiting for her to tell us shes in the witness protection program next!
Thanks for clarifying the link though!

As for boycotting sponsors.... I can see both sides of this.
If you're a sponsor who has been around a while, you're faced with the choice of lots of lawyer fees and a prolonged court battle. And if the ruling should go in favor of Acacia, you're liable for all of those years of past usage in addition to future payments. Meanwhile Acacia is offering to settle for what is comparitively peanuts. If you do not take their offer, you're taking a calculated risk of your company's future.
However, by caving and paying, you're basically paying off an extortionist.
Worse than that, you're feeding Acacia's cash flow and consequently their war chest to fight this in court. And the really scary thing is you're validating their business plan. There are tons of internet patents out there which are ripe to be treated in this same manner. For that reason, there really is some logic to a boycott.
I would much rather see sponsors taking whatever small percentage Acacia is willing to settle for and directing it to whatever group is best poised to collectively fight this in court be it IMPA or whoever. But it isn't realistic to expect something like that out of this industry, there isn't enough trust between each other, and everyone looks out for #1.

Who are you accusing of lying there, and of what?
Is Serge lying that the Netpond guys didn't check the IP?
Is Serge lying that the IP matched?
Or are you saying that Meat and Aga lied?

It's ALL bullshit.
First: I've never even heard of father time.
Second: I haven't posted on netpond in a couple years at least.
Third: I don't have a static IP.
Fourth: I've only ever used one nick on the boards up until I got bored with it.
Fifth: even if anyone actually figured out who I was, it wouldn't really matter to most of them.. most probably never heard of me.
I keep minimal but longterm business contacts, i've never been to a show, and I generally keep a low profile without ruffling any feathers.

There ya go!
And that's the way it's always been, and the reason guys like Xpics were able to make a fortune despite blatently pissing in the well we all drink out of.
We're paying for it now with Visa squeezing the nuts of the entire industry and most people haven't learned a damned thing. But hey, it's human nature and if anything, this industry is ALL about human nature....
I am still undecided as well. I will know more later. However, I am not going out of my way to do more business with those who sold out. I would also be interested in doing MORE business with those who are still fighting.
The bottome line, business is business. If other companies cannot convert or make me the same amount of money as those who settle, it would be stupid to boycott them. However, if there are REAL alternatives, where I can not lose money.... I think I would lean towards not working with those who settled.

BTW, Carrie, The Truth Hurts was telling the truth about Netpond IP....I din't check with Meat and Aga.
..but I found who he is nevertheless...
he is an emploee of one of the companies which settled, and the reason he doesn't wanna reveal who he is -
he wasn't talking very high about his boss on GFY in one of the pisses with me.
This industry is very close tight and there are much less degrees of separation than one might think
;-)))
so, TTH, now when I know EXACTLY who you are, what you do and who signs your paycheck,
tell us more on the subject of the thread from INDEPENDENT enterpreneur point of view you have no clue about
;-)))))))

Serge, if you want to be technical, I'm not an 'employee' of anyone.
I'm and independent contractor, for which I receive non-employee compensation.
If you want to be even more technical, I've never even met anyone from the company in question. I don't go around propping up anyone, I will however try and defend those who I feel loyal to, and those I've had successful business relationships with. I wouldn't expect you to understand that.
And if you want to be even more technical than that, aside from not outright telling you who I am, I've made no actual effort to conceal my identity, and there's about 15 people that have either figured it out, or i've told.

I've even posted here as ''myself'.
you are "independent contractor" whose 90% of income comes from the same source. (make sure IRS recognizes it as "independedt Contractor, the guidelines has been changed recently) I love being VERY technical
;-))))
your right, I don't understand your definition of "loyalty"...to me it sounds like one protects the source of 90% of hbis income, without which you go to flip burgers...
don't get on the high horse, sonny, I see you thru
;-)))
Originally posted by Carrie@Oct 26 2003, 07:32 PM Thanks for that Serge. I was getting grumpy that he seemed to be accusing Meat & Aga of lying in a roundabout manner.
In ebonics... Dems mah buds
And based on your 'facts', I know exactly who told you who I am.
I do have a very good memory.
Amazing what some people will do to kiss your wrinkled ass.
What you might see as a bad business choice, I chose to balance my life between work and family, and thus I cut out the bulk of my other work, focusing on the people I'd been doing work for the longest. Again, a loyalty issue, something you know nothing about.
