Hollywood is going after advertising companies who help fund pirate websites, and has now won a landmark victory.

Two Hollywood studios, Disney and Warner Brothers won $400,000 damages in a legal settlement case with Triton Media for contributory copyright infringement and inducement to infringe.

Triton was placing advertising services for a number of sites including free-tv-video-online.info, supernovatube.com and watch-movies.net that stream or link to unlicensed content. A Federal judge also barred Triton from deal with the sites.

Apply that same precedent to adult and all these dating sites etc. buying ads on illegal tubes, torrents and file sharing forums are subject to similar lawsuits by content owners.

What is most interesting is that this does not appear to be a default judgement, but rather a case actually decided on merit. That makes a huge difference.

In my mind, it is clear: We have had a few years of piracy free for alls, but even the various governments are starting to clue in that this stuff is incredibly bad for the economy, and is doing much to hurt the business of the arts, software, etc. It has taken a while for the courts to catch up, but soon enough piracy will be pushed back underground where it belongs.

Sorry but it appears that this was a default judgment and not a true trial on the issues...

Here's a story about the lawsuit indicating it was only filed on August 24, 2010. So I wouldnt get excited over a default win. The issues were never adjudicated so this finding is a lower court ruling and has no effect on other cases before this court or any other court.

In all honesty, linking to techdirt as a source isn't exactly reliable. Mike Masnick is so pro-piracy that he has a jolly roger flag shoved up his ass. You read the article and you see that he doesn't get it, doesn't realize that the ad companies are the "third leg" that holds all these things up. It is the financial incentive, the way to pay for the infringement.

Follow the money... few torrent / illegal tube / file traders do this shit for free.

The complaint was filed August 24, 2010. Which means it was served shortly thereafter and Triton had 25 days to respond. Which would have put their Answer due some where at the end of September. When they didnt respond to the lawsuit, Disney & Warner Bros filed their motion for default judgment.

It would have have taken til the end of October for that to be signed by the judge, if Triton didnt respond. By the beginning of November the judge would have signed off on the judgment and viola we have a news story about Disney and Warner Bros getting $400K on November 1st.

If the matter was tried on the merits of the case it would have taken at least 1-2 yrs for it to come to a Motion for Summary Judgment or trial.

No case goes from complaint to resolution in 60 days unless no one opposed it.

I only linked to that story because he had a copy of the complaint. I didnt even read what he wrote.
