Federal Grand Jury Charges Florida Man With Obscenity Violations

WASHINGTON, Sept 16, 2008 /PRNewswire-USNewswire via COMTEX/ -- A Florida producer has been charged by a federal grand jury in Billings, Mont., with distributing obscene DVDs through the mails, Acting Assistant Attorney General of the Criminal Division Matthew Friedrich and U.S. Attorney for the District of Montana William Mercer announced today.
In a sealed indictment returned by the grand jury on Aug. 20, 2008, and unsealed today in federal court in Billings, Miami resident Barry Goldman, 58, doing business using the names Torture Portal, Masters of Pain and Bacchus Studios, was charged with three counts of using the mails to deliver DVDs containing obscene films to an address in Billings and one count that seeks forfeiture of certain assets of the defendant. The specific films named in the indictment are "Torture of Porn Star Girl," "Pregnant and Willing" and "Defiant Crista Submits."

Well, we are certainly seeing a trend here. One that is somewhat comforting, but disturbing, just the same.

On the "good for me" (in the third person,) it appears most of the prosecutions seem focused on extremes, and fetishes. They particularly don't like aggressive sex, or bondage.

On the disturbing for us all side, they are still trying to pull this crap. At what point are they going to realize, the American public wants to be left alone with their sexual desires. They don't need some government busybody deciding who, or how they have sex. Or worse, a government busybody, all spun up by a special interest bible thumper group.

In a weird way, I understand that this will end up defining what is acceptable, as they slowly whittle away from the extreme ends of things until they get a "not guilty" that will draw a line.

I had a quick look at their website (Masters of Pain has a video selling portal on page one of google for their name) and the stuff is (a) very amateur, (b), seemingly pretty brutal, and (c) does appear to portray less than consentual sex activities.

It would also appear that (d) they were stupid enough to sell the DVDs and send them through the mail.

Emp, I agree with you, the American people don't seem to want the government in their bedrooms, but at the same time, they are still shy about actually coming out in public and saying "I like bondage and want to keep my videos". There is still a massive shame and blame game played, making people feel they cannot admit their own desires or preferences.

You are right probably many more think its no ones business than who think it is. When they decide to speak up it will be too late.

Will be interesting to see hwo things turn out. The mail aspect alway seems to complicate things and make it harder on the defendants.

The mail part makes it harder because (a) it's really easy to make it a federal charge, because the cross state line aspect is right there, and (b) because nasty prosecutors will order the videos from the absolutely most conservative places they can find, and they cry community standards to the judge.

At some point, the judges will have to wake up a start ruling against these types of cases, because the videos were only sent by request, effectively making the interstate transport as much the receiver's fault as the senders. After all, if the community is that conservative, nobody there would have normally ordered these videos to start with.
