Search engine spammers really piss me off in some ways. But, FWIW, they're obviously really good at what they do. So, I don't feel bad about going after them for trademark infringement on two terms that I have had trademarked for many years.
Before they use a site name or catch phrase in their meta, the should make sure they aren't going to get a c & d from a company's sheisters. Taking a site's name in vain, popping up number 1 in the engines, and advertising another site with a trademarked site's name is gonna get them at the wrong end of an expensive trip to court. Not expensive for me, because they're gonna be paying MY sheisters as well as theirs. h34r:

They have the ability to spam the engines. (not a bad thing) They have the ability to turn up on top for a given search term (again not so bad) They convert like SHIT off pure gold traffic because they ARE NOT sending them to the site the surfer searched for. Se traffic should be the easiest thing in the world to convert, especially if your surfers find you by searching the a site name. You know exactly what they are looking for if they do that, and makes them easy to sell to. Runnin a site in the meta and not sending the searches for that site to the appropriate sponsor is like running a huge advertising campaign for Pepsi but only selling Coke in the shop.

What's the cost to go after a trademark infringer? I know you say you'll get your fees after winning, but what if they don't have assets you can find?
I am really naive about all this but our attorney says we will have to go after someone using our trademark one of these days. We've done the c & d and that's worked, but we're not always going to be lucky. Thanks |

That depends on your shiester Maureen in oz.
They charge by the hour, so it's the lawyer factor. As for court, it doesn't take long to get a summary judgement when you have hard (printed) evidence and complete contact information for the moron that dared to fuck with you. bing bang boom.
