It's a fine line, but I think it misses a couple of points:

1) Did the website / blog in general deliver news, or is it a single issue site more narrowly focused on an opinion rather than fact,

2) Was the intent to disseminate fact, or to just build opinion. Essentially, is this news, or is this a buy walking down the sidewalk with a "the end is near" sign begging for quarters?

3) Does the act of publication grant immunity from libel and slander laws?

It's an interesting case, one that the blogger / site is likely to lose in the long run.

I can tell you that I hear that Shellee's appeal is being reheard by the NJ courts concerning her case so all of this isnt over yet as far as this business is concerned.
