Great point you have made.. the problem is that foreign webmasters won't go to jail for this game, US webmasters will.. so US webmasters have to deal with the rules, and it does make it unfair in respect to foreign websites, so yes, it is unfair advantage of offshore sites.. but as long as you have US-based assets, hosting in the US, processing in the US, you have legal liability.
