I think they can choose to prosecute federally because they shipped their tapes across state lines......Im sure they see Extreme Associates as a slam dunk because its so, ummmmm, extreme! It seems like it could be a double edged sword though, if they lose this case then how could they prosecute more vanilla stuff and hope to win?
