What I see here is this: If Avenue Media (flying croc I believe) wins this case, it will create a precedent that can than be used against them.
i.e.: If it is ruled that software cannot modify a user's computers/settings/programs, it will set a nice precedent to go against Avenue Media and the other spyware.
