My thought is that it doesn't really matter what we think, it matters what's legal.
Since I've never been arrested for murder, I don't know at what point the state (or whatever arm of the govt. is prosecuting) steps in and takes legal possession of the defendants property.
Personally, if I were her mother, I would have had my fat ass over there picking up as many things as I could get and then let people decide if what I did was wrong or not.
