TRENTON, N.J. - Naked Rhino Media has filed a defamation and breach of contract suit in federal court against Too Much Media, creators of the NATS back-end affiliate program software, and the company’s Chief Executive Officer John Albright.

That's hilarious. Maybe now some of these people that take every little thing to the boards like it's accepted business practice will think twice.

I don't condone what they did if they did shave, but NATS had no business posting it. Very unprofessional.

It is funny though that it doesn't seem that Rhino is claiming they didn't shave, they are just suing because they claim NATS intentionally libelled them because NATS isn't foolproof and they wanted to do some damage control before everyone started pointing that out.

I can tell you this...This whole situation is going to get VERY ugly before it gets even close to being better.

There is some seriously shady shit going on by one of the parties involved, and that will come to light VERY soon. All this lawsuit is, is a distraction from the original topic at hand.

The fucked up part of everything is that the actual complaint is full of so many lies that it could end up getting them into some trouble if anyone is called to speak their sides.

Chris and Brandi never started anything on their own, everything was Vegas and Angel's brainstorm from the start, in fact there are about 10 people that can totally vouche for that considering when they launched XclusiveCash.com at internext, they stood up in front of about 10-15 people and said something to the effect of "this was Vegas and Angel's idea from the start, and we are proud to be a part of it"

As far a I can tell, they're saying "Hey, you guys caught us with our hands in the cookie jar, but then you told everyone about it which caused us to drop the jar so now we're suing you for breaking our jar."

I read the complaint and thought it was humorous as well. I'll bet anyone money TMM wins, and not only that, it gets thrown out of court in a relatively early stage. I hope the lawyers are getting paid and not working on contingency, i'm sure they would know better than to take contingency on this one.

What's classic is what was originally posted by the TMM crew was something along the lines of "There was a discrepancy, we were met with profanity and resistance, so we are terminating their license." They never said they shaved. In the complaint, NR cites all these board posters for making insinuations on shaving. Technically - they should be suing those people, not TMM. I'm no lawyer, but the original statement were statement of facts that cannot be denied as false, nor have they been denied as false.

It's been awhile since I saw the thread, but as I recall, they accused Rhino of discrepancies, that although may not have been a direct accusation, certainly inferred shaving.

The reality is, regardless of calling out another business' ethics on the boards, if NATS is found guilty of libel, I believe they will have some serious reprecussions to face that will hit them directly in the wallet. They're not the only game in town.

Read it, over and over again and point out where NATS said they were shaving. If NR has issues with being accused as shavers, they have to go after the people who literally said it and brought it to that level. Good luck proving inferences in a court of law, especially with that original statement.

As for TMM, if they lose significant business over this (which I doubt), based upon false claims in the complaint and the fact it was published on big websites (the fact they made it sound like it was a cover up for faulty software - who knows if this is true), I would say they have a much better case as a counter-suit, but I don't think there is any money to collect. John and crew are very smart, and his statement is nothing but a set of facts.

Proving libel is incredibly difficult. First of all they'll have to prove that what was posted wasn't true and then they have to PROVE that it affected their business financially. Good luck on that one.

This is exactly why you should NOT censor a board. If you do, you are exercising editorial control in which case you are assuming some responsibility for what's posted. Prodigy and Compuserve worked thru this nearly 20 years ago.

It's GFY. It's a forked tongue spam board that caters to friends and sponsors. There're no guidelines of steel over there. It's about favoritism in business and even though it's no standard in excellence, the minute the shit started it should have been squashed.

I'm surprised they're not included in the action for allowing that shit to go on past the first post. However if you insult a friend of one of the moderators you're gone in 60 seconds.

i think it should. if someone takes it upon themselves to play judge, jury and executioner, then takes steps to hurt another company, then they should be liable for damages that result. people are too quick to throw around the words "theif" - "shave" etc. it seems like more than 90% of people that complain or are calling someone out are the ones at fault.

Go back and read TMM's statements again, ignore what everyone else said. TMM chose their words carefully, made no accusations. They simply stated what had transpired and why they'd suspended NRM's software license. Not once did they used the words thief or shave.
