Scalia on arts funding and the thin line between porn and art...

................................... Scalia said the Supreme Court has not done a very good job of framing a definition of obscenity, which the First Amendment does not protect. "The line between protected pornography and unprotected obscenity lies between appealing to a good healthy interest in sex and appealing to a depraved interest, whatever that means," Scalia said in stating the court's position. The result is that every small town in America must tolerate the existence of a porn shop, he said. |

Not only the First Ammendment issues, but whatever happened to that little "restraint of trade" thing? Why doesn't that pop up more?
I had a lively discussion with my husband regarding that National "No Call" list that allegedly existed to prevent people from telephone soliciting. I called it "restraint of trade." He called it something else entirely. I said I had absolutely NO sympathy for those lemmings that can't ignore a ringing phone during the dinner hour or let the machine screen the calls. Frankly, I have a similiar attitude toward spam. I may bitch, but it was *my* choice to keep my personal email in Outlook, which causes me to have to hit that nice big red "X" to get rid of spam. My work email comes through Thunderbird, which is trained to delete the spam. |
