Federal Court Grants $2.8 Million Judgment Against Purveyor of Stolen E-mail List

LAS VEGAS, NV, February 18, 2005-- The federal district court for the district of Nevada has found Eric Suchomski, a.k.a., ‘BigMike9712’, liable for offering to sell a valuable customer list know as the “CE list” on a popular webmaster chat board.

The Defendant was ordered to pay over $2.8 million dollars in damages to Plaintiff R.P. Ventures, who owns and maintains the list. Suchomski, who was found liable for misappropriation of trade secrets, conversion, violation of the Computer Fraud And Abuses Act and for misappropriation of computer data in violation of Federal law, has been permanently enjoined from selling, attempting to sell, dispersing or otherwise disseminating any e-mail addresses belonging to Plaintiff and from accessing computer systems housing such lists.

The judgment that was entered against the Defendant included $2,340,00.00 in actual damages, $500,000 in special punitive damages, disgorgement of profits and an award of Plaintiff’s attorneys fees and costs.

A spokesperson for R.P. Ventures and CECash said, “This is a warning to others that they should expect the same treatment if they traffic in our stolen property. We will continue to police our valuable trade secrets and prosecute individuals to the full extent of the law.”

Suchomski lost for not showing up, it's a default judgement. So unless he files for an appeal within the alloted time, it's not really a precedent just yet.
