Also, in case anyone is interested, we have the feed of the radio show we hosted with guests Richard McKenna, Jeff Costakos, and Paul Hunter. They are intellectual property attorneys from the firm Foley & Lardner. It was quite an informative show and might answer questions if you have them.

Patent Discussion

I can't wait to see the outcome of tomorrow's hearing.

Thanks for the link Becky :)

Had a great time at dinner with you in Vegas! We should not wait until the next show to get together. Come on back to Colorado this Spring, I "might" even let you take me up that damn mountain again! :P

Good info. Anyone notice ACTG stock popped up yesterday when the rest of the markets went down overall.

I did notice that the stock has dropped today, and rest of markets were even/up.

Mike, you have to look closely at combimatrix stock prices as well, as the structure of the two tracking stocks makes it possible to play combimatrix by buying Acacia stock.

It is possible to do a sort of "short and long" on the two when the prices shift unevenly. CBMX has bird flu related stuff going on right now, so there is some speculation in that stock.

The stock makes a bunch more sense if you consider the combimatrix angle combined with what seems to be some VERY good guesses by people just before news on the stock.

will they file for summary judgements at the Markman Hearing? or does that come later?

Alex, I have read the yahoo message boards, and have noted the other stock plays a part. It is a little past my understanding of it. Thanks for the explaination!

I believe the judge first needs to rule that the words and definitions used in the patent don't apply to the internet.. then a follow-on court session which is probably a Summary Judgement for non-infringement.

Markman Hearing could take a couple of months to come to final conclusion on Acacia's claims.

Then again it could take years, too.

NPR ran radio story this morning about Acacia.

Spike and Berman interviewed:

A quote from Berman from the NPR interview:

"We do believe that these patents are broad and are being widely infringed, and are strategy is, to frankly, dip our beak and just take a little bit of money from a lot of people and we would be prefectly satisfied."

Dip our beak?

Not a good quote to use at all. IT shows that his mind is on the Godfather, and looking at their strategies that is exactly where they got them.

We know now who the "Frados" of the industry are....
