Just completed an article titled: Markman Hearing Primer.
I got a copy of some court docs that should be interesting reading along with a very interesting point of view by Spike at the conclusion of the article (be sure to read the whole thing and not just skip to the bottom). read there: http://www.fightthepatent.com/v2/PreMarkman.html discuss here: Fight the Inquiring Minds Want to know! |
Thank you. It was good stuff!
Fingers crossed and tits in a bra. :cdance: |
"It will be our business decision to not invalidate the patent. We'll accept the non-infringement verdict and go home and wish best of luck to the cable and satellite industries to deal with the DMT patent. "
The implications of this outcome would mean that the defendants and anyone who uses digital audio/video over the internet, and who has not licensed the patent, would not be infringing on the patent. The companies that already licensed the patent would have to continue to pay licensing fees. These companies would have a difficult time to break their contract, because they voluntarily agreed to the definitions that Acacia used in the license. For those involved in the fight, it would be a bitter-sweet victory to show the rest of the Adult Industry that those that signed were on the wrong side of the fence of this major issue. While I am sure there will be shouts of joy at the conclusion of this story, it does illuminate how issues like patents can divide companies and industries. " Very interesting. |

Invalidating a patent does require more money and effort, and it does make for a good "business decision" for the defendants to just fight for non-infringement and go home. Fight the Irony! |
Yeah, I think the people who have folded will have bigger issues then people boycotting them. From what I understand a gaggle of patent holders are lining up to take their bite of the apple. I wonder if these "business decisions" factored in this....
