One can only hope this goes the way of the fat people suing McDonalds.

What we REALLY need is someone to go to McDonald's and say "Eeeny Meeny Miney Moe" while deciding between the Big Mac, Quarter Pounder with cheese and an McRib, and order a hot coffee to go! :okthumb:

RawAlex 02-10-2003 06:10 PM

Man, some of these people need to get the stick out of the asses and get on with their lives.

It would be such a good thing to have a law that limits this bullshit to $500 or something like that - that REAL damage has to be shown, not just offense... otherwise contestants on American Idol would be able to sue the rude Simon guy... that is offensive.

Is there such as thing as a legal bitchslap? Or is that term not pc either? <_<

Raven 02-10-2003 08:13 PM

Ok. Call me an immigrant.

But, I grew up with

eenie, meenie, mynie, moe...catch a tiger by the toe.

Must be my Northeast upbringing.

Stupid. Stupid. Stupid.

BootyBoy 02-10-2003 08:20 PM

Good thing a Denny's waitress didn't say it or they'd be in trouble again :P

PornoDoggy 02-10-2003 08:50 PM

Probably wouldn't be wise for Adam's Mark Hotel employees either.

Brad Mitchell 02-11-2003 12:10 AM

I'd be curious to hear the age of the flight attendant.... I'm 27 and I've never heard that was the origin of that nursery rhyme. Of course I'm from Detroit and we happen to like black people up here, too. (lol) Just another frivolous lawsuit, obviously, based on an absurd inferance. Shoot, even if it was truly 'inferred' it doesn't seem to me that one should be help accountable for their thoughts.

And for Brad, we will be holding Remedial Reading 101 classes :awinky:

I'm 41 and was raised in the south by southern parents (who had southern parents) and while we always said "Tiger", it was well known and giggled about what word "Tiger" replaced. My mother's father was VERY racist, or I'd probably never even heard it at all. My parent's generation probably said it routinely, but not mine.

SykkBoy 02-11-2003 02:08 AM

Black people need to realise white people aren't out to get them (anymore, now we're out to get the bad arab gentlemen)

LadyLaw 02-11-2003 10:53 AM

If I was defending this case I would argue their "humilation" was caused by projection of their own unease with being black in a largely white world, and not by any flight crew remark:

"A very prevalant and damaging aspect of Borderline Personality Disorder is projection. It can also be one of the most difficult defense mechanisms to recognize, to own and to become aware enough about as to be able to change the associated projected thinking from a focus on "other" to realizing what you are actually feeling yourself.

"In projection, one's own unacceptable feelings are attributed to someone else. A boy who dislikes his father, for instance, may feel anxious about disliking someone he depends on. So he may project his feelings onto his father, concluding that 'he hates me.' A person who has uncomfortable sexual feelings about members of a different ethnic group may project this discomfort onto them, saying, 'those people are dirty-minded and oversexed.'" (Pg 389 -"Psychology" Second Edition by Wade & Tavris)

"If you are borderline, you most likely have powerful effects on other people's feelings and behavior. Your tumultuous emotions and dramatic, often provocative behaviors are sure to elicit strong reactions in others. Your environment often becomes a theatre for playing out inner conflicts. Other people may become screens onto which you project feelings as if you are thinking, 'someone here is angry.' It can't be me, so it must be you.'

Flight attendants are evil, bitchy shrews - we all do enough flying to know that is SO true. However, I'm inclined to believe that she thought it was "tiger" too - that's what I always thought it was and I grew up in a very racist small Ohio town. I wouldn't be surprised to have heard that version on the playground growing up - but never did.

And I agree on frivilous lawsuits - c'mon....give me a break! :nyanya:

Kath....LMAO!

Thanks for stating the obvious...flight attendants for the most part ARE evil bitchy shrews.... :D

But still, this lawsuit just reeks of FRIVOLOUS!

If anyone has ever flow southwest you know they do everything differently. They have poems songs and jokes for everything other airlines routinely do. So to choose that one quote....They must have had no sense of humor.

But I do find it humorous that the article kept reffering to "the sisters" and although they are actually sisters...why don't they take that out of context as well and sue the news for racist remarks?

originalheather 02-11-2003 02:26 PM

Silly.

I was raised in the US..my parents said that rhyme to me as eenie, meenie, minie, moe, catch a piggie by its toe.

So I guess they should have been sued by pork producers or something.

"Plaintiffs' attorney Scott Wissel said the sisters also want Southwest to stop using the rhyme and provide employee training to prevent such incidents."

it sounded immediately like a "SouthWest" thing to say, just as ShannonRush said. I would bet money on that and that this case will be thrown out of court. They have a small, cute remark for every mundane detail that flight attendants deal with routinely. Its pretty entertaining and helps you to forget that in a few minutes, you will be force-fed a hot chunk of cardboard for lunch.

i really believe that the legal system in the US needs a dramatic overhaul. I think there needs to be a better balance of boundaries to freedom - or you are not free if you are living your days knowing that someone can seriously disrupt your life for the most frivilous of reasons using the very system that should be protecting you.

i had a car accident once and even the people walking down the sidewalk immediately grabbed their necks and fell to the ground, writhing in pain and calling for help. many of these people were several blocks away. people came stumbling out of restaraunts and apartments holding their necks. :( at that moment i realized that we have a legal system structured in such a way that it often will hurt the innocent just as much as it will punish the guilty. in fact, by design, it encourages that behavior.

when you live in a place that has to have a label on a hair dryer saying "CAUTION: do not use while in the shower" - theres a real problem

Boortz had this on his site today and brought up again what he's brought up many, many, many times (and he's an attorney):

We need "Loser pays" system.

I'd also love to see professional jurist - or at least something better than those that couldn't find a way to get out of jury duty. :( I was watching one of the reality court shows last year and was horrified to see the alpha personality jurists literally talking the submissive jurists into voting their side until it was unanimous. And this was a murder trial. Scary as crap knowing that someone's life depended how the jury was stacked personality-wise. :(

originalheather 02-11-2003 03:42 PM

I agree with the statements made about the US legal system..but what's even more scary is living in a country that uses the Napoleonic code...guilty until proven innocent.

I was accused (it was a total bullshit accusation that was later dropped) of taking funds out of someone's bank account via the internet...I would have had to prove I was innocent..they didn't have to prove me guilty. Ponder that one a while...how DO you prove yourself innocent in certain cases?

It was a pain in the ass, cost me attorney's fees and even though it was a complete lie, they didn't force the person who accused me to pay those fees.

I totally agree that in any suit deemed to be frivolous, the loser should have to pay all expenses, including those of the court.

I'm currently being sued by an ex-maid that QUIT for "unjust dismissal"..she's suing me for almost 10K dollars in lost wages, severance, vacation pay, bonuses, etc....and the bitch QUIT in front of 3 witnesses. I treated that woman like a member of my family, paid her 3 times the average wage, educated her kid, gave her gifts, etc...and get sued. Her entire deposition is a pack of lies from beginning to end, and I can prove it a dozen different ways. But it's going to cost me about 1K dollars in attorney's fees before it's over. Do you think anyone's going to make the "poor opressed worker" pay me back? Hell no.

Other countries are starting to take the cue from us, the overly litigous Americans..where will it end?

magus 02-13-2003 03:38 PM

there is a 'loser pays' portion to american law.

it is called in the vernacular a counter-suit.

all you have to do is file and you will usually prevail as long as you are diligent in your approach and document your damages that arose from the frivilous suit.

problem is, most folks who file the first suit, do not have the where-with-all to pay damages on a countersuit. so.........the righteous never bother but like to complain about it.

that is their own damn fault

Right on. I agree and if you really think about it it prejuice in reverse. The days of "up in your face dare you utter or think the wrong thing" is over. Tolerance goes both ways.

I grew up with the n** version. It's was actually pretty common in the south (florida) and we're talking real south, old florida folks.

I think it depends on where you were raised.

ShannonRush 02-14-2003 03:09 PM

No matter what version we grew up with...the fact is the attendant said pick a seat...we gotta go. She didn't wanna catch anyone by their toe.

I am sure there are many phrases out there that originated with some kind of racial or morbid slur that has now been turned into some kind of a common phrase.

I can't help but think, when am I, a white female, going to be able to sue someone for not letting me enter black miss america or have my views spoken on black entertainment television...And can I send my kid to college through the united negro college fund?

Enough is enough...we are not "out to get" anyone...can these girls say the same?
