Private Sues BoneProne, 'Porn Mafia Family' for Infringement
PORTLAND, Ore.—Iowa-incorporated and located Fraserside IP, a Private Media Group subsidiary, filed a copyright and trademark infringement lawsuit in U.S. District Court in Portland, Ore., on Friday, alleging 126 known instances of infringement of its content by BoneProne.com and the so-called "Porn Mafia Family," using a bevy of alleged aliases.
The lawsuit is Fraserside IP v. Jones. The websites used to perpetrate the alleged infringement are also named defendants under these DBAs: BoneProne.com, TubeKings.com and SoCalMovies.com. People named are the abovementioned William Michael Jones, aka Michael Jones, aka Mike Jones, aka Mike Bone, aka BoneProne; and Mindy Jones, aka Mindy Jacobs, aka Queen BoneProne, aka “Porn Mafia Family." Other defendants include La Vista, a Philippines entity; Chin Holdings China, a Panama entity; Marvin Greencarrier; and John Does 1-100 and John Doe Companies 1–100. The 60-page complaint—which was filed by local attorney Lake Perriguey and Fraserside attorney Chad Belville, who has requested leave to appear pro hac vice before the Oregon court—tells a sadly familiar narrative of infringing activity perpetrated on a large scale through the intentional creation and use of a sophisticated business model whose sole intent is to "capitalize on the illegal dissemination and contribute to the illegal dissemination of infringing works." Just read that... WTF was he thinking??? scrape tube sites that have stolen content on them and then embed that content onto your site. + posting that you make tons of money and one of AFF's biggest affiliates.
You may not be "hosting it" but you displaying it on your site. Seems like it's going to be an easy case to win. Even if BP could win it some how he is still going to lose from the legal costs. Funny, on GFY BP starts running his mouth that he is going to show them and that he is poor and don't own anything. Amazing how fast someone goes from bragging about riches to poor mouthing in a matter of minutes. I am sure the courts will figure out his net worth. He also claimed he didn;t make any money from those sites. Don't think it really matters if he made a lot of money from the sites or not. They still going to try to take the money you made from other stuff and you still going to be liable whether you made a lot of money or not from their content. |

I doubt that he ever was a "baller" either. We had a good time with him years ago on Oprano radio exposing his pictures and video of one of his baller adventures in his rental car. I enjoyed watching in Vegas as he was in awe as JoeSho introduced him to all the players sitting around the bar that I figured he would have personally known. But then again as Hellpuppy will attest the guy had no idea who was behind the bar pouring him his free booze to begin with... the biggest true baller in the room. |

Boneprone already admitted he scraped videos from tube sites and embeded them on his tube site. And it's not like he was embeding youtube videos, he was embeding videos from Famous well know tube sites that had stolen content all over them, he knew 100% what was going on but was dumb enough to think he could hide behind the "but I didn't host the video so it was ok to display it on my site even though it was stolen" argument. SO BadDog, what is there to be innocent of ??? displaying videos of stolen content on your site is ok now? but displaying videos on a tube site of someone you don't know isn't ok? I have to say that this has been a long time coming, shocked that it hasn't happened sooner.
However, I think this case still has some legal pitfalls and issues to look at. The real question will be "is embedding publishing?". I think the answer is yes, because it's the site owner that chooses to embed or not, no different from choosing to put an image in a newspaper or magazine without permission. Clearly, a site who's motto is "free full length porn movies" fully intends to violate copyright and use material without permission. Further, because they clearly admit that they have the power to remove stuff from their site: Quote:
