I would think most people would try to maintain a level of consciousness about how they present themselves online.

You have to wonder if TMM even considered that possibility before filing their suit. They may eventually win, but at what cost?

By getting the shield ruling up front, the entire case can be appealed over and over again, all the way up. It's a perfect care for the Supreme Court as well, as it slices an issue which is fast becoming a real problem: Who is and who is not a "journalist"?
No matter the outcome, this one could take a decade or more to play out.

If I had a dollar for every phone call I get from someone claiming they were defamed online....
Defamation and libel are really difficult cases to prove when it comes to damages. I like tortious interference with business relations or prospective business advantage instead. Easier to prove, less mess and greater damages.

Honestly, it's about time that people were forced toward responsibility for their actions. An attempt to destroy a reputation is not less damaging because it appears on a forum (or blog) - and I've seen good webmasters destroyed on the whims of meaningless trolls.

Best to cover your ass at all times, clearly people become too familiar on line, most likely developing a false sense of security as well as anonymity. I liken it to being in a group of strangers or meeting someone for the first time, social conduct...

And our court system could be instantly unclogged and the entire judicial system reformed with just one little law passed:
LOSER PAYS
We wouldn't be having this conversation. TMM was obviously pissed about the whole situation, but with hindsight of history, has it impacted their business at all? Not that I can tell.
