This is truly problematic as well is "sextexting." If underage children are not prosecuted for posting naked/sexual pics of themselves or sending them to their friends via cell phones, it could leave a loophole for CP. I cannot see how 17 yrs and registering as a sex offender is proper. But there should be some punishment... perhaps no jail time with probation and a clear record if there are no other arrrests by the time they turn 18.

maybe governments should look at lowering age of consent to 16? as then the grass won't be greener, after all when you prohibit anything it becomes more popular look at the prohibition time for drink...

There is the letter of the law and the spirit of the law. A special Someone reported it to the Passaic County Sheriff's Office so they could not blow it off so they conducted a month long investigation and made the arrest of the 14 year old girl for possession and distribution. Allegedly she published over 30 pictures on her myspace page.

So all her friends if they downloaded any of the pictures could be getting a visit from the sheriff's department.

Since this is a juvenile it will go to the juvenile probation court and there they will determine whether they will divert the case or take it to the next level. The juvenile justice system is somewhat different than the one for the big boys and girls.

There are few other more important issues here, such as parental supervision, Myspace's responsibility to police content, etc. Not to mention that with the proliferation of cell phones with cameras the kiddies have made a habit of sending their privates along with the text messages.
