Man upset about overdraft fee sues First National Bank

A former First National Bank and Trust customer filed a lawsuit against the bank in Martin Circuit Court Wednesday, asking for $2 million to compensate for stress and pain he said he suffered over an overdraft charge on his account.

Barnard Lorence filed the suit himself, claiming he was treated rudely by a bank manager when he asked to reverse the $32 penalty he was charged for overdrawing his account by less than $5.

He accused the bank of falsely advertising that it cares about its customers.

What they don't say is they have at least one manager who will be obnoxious and arrogant if one attempts to try to communicate with the bank," he wrote in his suit.

Lorence said he has brain damage from a 2001 accident and the stress of the conflict with the bank is making his condition worse. He said he can't sleep because he can't stop thinking about it.

He asked for millions, saying a few hundred thousand dollars would be a slap on the wrist to the bank and it deserved to be "paddled."

Bank officials did not return a call for comment.

i hope they countersue him for lawyer fees, they won't,because of the press, but it'd be a nice slap of reality for him if they did. "guess what...you're broke, loser!!! your next court hearing is in bankruptcy court!"

Must have really been a slow news day ... I wonder if they write articles about crazy people who talk to themselves on the street?

A licensed attorney who can breathe and file a brief will get that dismissed in about the time it takes to get to the courthouse. A first year law student could probably write the brief.

It's not going to cost the bank any money, because if they don't have a house attorney that would be covered under any standard retainer.

If the bank IS out any lawyer's fees for this one, then they deserve that loss.

This isn't even up to the level of the "frivolouslawsuitsthatmustbestoppedtohonorgodandsav eourcountry" that the Republicans rant on about when they are proposing protective legislation for whatever industry is bankrolling their latest campaign (the gun manufacturers and the drones at the NRA, the pharmaceutical industry, etc., ect., etc.).

Guess it's a good chance to laugh at a crazy person, though ...

Ahhh ... but there's no lawyer involved - he filed the suit himself.
