Correspondence from GAC Chairman to ICANN Board regarding .XXX TLD

12 August 2005

From: Mohd Sharil Tarmizi
To: ICANN Board of Directors
Cc: Government Advisory Committee
Subject: Concerns about contract for approval of new top level domain
Date: Friday, August 12, 2005

Dear Colleagues,

As you know, the Board is scheduled to consider approval of a contract for a new top level domain intended to be used for adult content. I am omitting the specific TLD here because experience shows that some email systems filter out anything containing the three letters associated with the TLD.

You may recall that during the session between the GAC and the Board in Luxembourg that some countries had expressed strong positions to the Board on this issue. In other GAC sessions, a number of other governments also expressed some concern with the potential introduction of this TLD. The views are diverse and wide ranging. Although not necessarily well articulated in Luxembourg; as Chairman, I believe there remains a strong sense of discomfort in the GAC about the TLD, notwithstanding the explanations to date.

I have been approached by some of these governments and I have advised them that apart from the advice given in relation to the creation of new gTLDs in the Luxembourg Communique that implicitly refers to the proposed TLD, sovereign governments are also free to write directly to ICANN about their specific concerns.

In this regard, I would like to bring to the Board's attention the possibility that several governments will choose to take this course of action. I would like to request that in any further debate that we may have with regard to this TLD that we keep this background in mind.

Based on the foregoing, I believe the Board should allow time for additional governmental and public policy concerns to be expressed before reaching a final decision on this TLD.

Thanks and best regards,

Mohamed Sharil Tarmizi
Chairman, GAC
ICANN

If the XXX people (and those who are speaking on behalf of the entire adult industry??? Did ASACP get their shit together, or should we still look at them as sell outs???) think they got this bagged, then they better think twice... if anything, then this will be used to remove support for ICANN, and more support to get TLD worked into some international organization.... This might be the TLD that down the road will mean that the internet infrastructure will develop regionally and not internationally (did they really think that all goverments around the world would just sit by as the internet develops???)

Also I talked with one of my mainstream domain business contacts, and they were amazed that the XXX business plan was approved by icann - especially with the other "niche" tld that have failed.

Personally I still think the XXX TLD smells of "bullshit, bribes and business" all the way... nothing to do with making the internet a more useful place (or whatever crap excuse they need to approve this TLD).

ICANN have opened a pandora's box...

I whole totally agree!

This will be the TLD that will change how the internet is managed, be it good or bad.

The ASACP have been very quiet of late ..

Their silence is acceptance of how things are going.

I will make sure that we will NEVER again pay a single cent to them or recommend their organisation... I hope others will follow - no need using resources on organisations working against our industry (unless the purpose is to crush them).

Chris why do you think we all are eating sandwiches? The morally straight and even some of the Feds are asking them to reconsider.

Show me where the morally straight and Feds are asking for reconsideration.
I'd be curious to see that.

What I find interesting is that the government and other groups objects to the issuing of this extension. That, to me, tells me they are worried by having it it may protect people from prosecution.

I still don't like the .xxx extension because it is something to be truly effective would have had to be done in the beginning and not now but the forces surrounding the issue and how they are reacting is very interesting indeed.

There was an xxx in the beginning but one not controlled by new.net or icann. I believe it was Pacificroot ?? they had a load of domain extensions that could be purchased such as .biz before icann stepped in and took .biz out of the open registry and xxx were taken over by new.net, which funnily enough had one of its board members i think on the icann board?.

With ICANN halting the XXX tld. for 1 month, then its time to turn up the heat... some of the most "vocal" countries against the XXX tld have been said to be Brazil and Denmark - would be nice if more goverments would show their disapproval of the XXX tld.

I wonder what ex. Canada thinks about this issue?

Btw. for those who have been lost in that one thread thing or just stayed away the last couple of days (who has time for a no threaded board in 2005), then here is the lastest news on the XXX tld:

I think new.net is still taking registrations for this if Im not mistaken.

I know new.net is taking registrations but they have been for a year or two? the domains are expensive and you have to have a plugin installed to see these, which is flagged on my system as tracking cookies and more, so it is deleted ;)

http://news.yahoo.com/news?tmpl=story&u=/ap/20050817/ap_on_hi_te/internet_pornography_3Thanks for the link. That's from yesterday... I should not have missed it.
Conservative groups such as the Family Research Council also expressed worries that creating a ".xxx" suffix would also legitimize pornographers.I thought this was funny. I wonder what Ann Coulter thinks about the issue. LOL

I know the price seems to be a roving target as well.

Didnt Robin Nixon have a domain plugin idea a few years ago?
