U.S. charges Renton firm, 6 others in porn spam case
Impulse Media Group says it's innocent, vows to fight in court
A Renton company is among seven firms charged by a federal agency yesterday with failing to control people paid to attract customers to their porn sites.
But unlike four of those companies, which have already settled charges by the Federal Trade Commission for nearly $1.2 million, Renton's Impulse Media Group Inc. said it will go to trial over the matter.
"We didn't do anything wrong," said Impulse President Seth Schermerhorn, whose company runs porn site SoulCash.com. He declined to comment further.

Good for them. If they feel they can win and they are innocent then more power to em. :)

Will it be the rogue programmer or rogue affiliate defense?

Problem is , after legal fees etc etc...
I think the firms that just paid the fines probably did the prudent thing

they'll keep em dragging on for years, and even if they win, good luck getting the money of the feds.
Mr Schermerhorn ---- sounds like like Richie Rich's great uncle or something.
:)
I've known Seth for years, we used to work together and he's one of the best guys I've ever met. If he says he's innocent, I believe that he his. I hope he's able to win this fight.

i think any reasonable person would have to believe that they have a case if they are going to challenge the federal government. thats not a small decision to make. i hope they come out ok... it would be nice to see some hands get slapped on the other side from time to time :)
I'd love to see Seth and/or Topbucks win against the FTC, but the reality of it is that they'll spend a ton of money, time and effort to end up with a settlement that doesn't exonerate them, just produces no admission of guilt. That's the problem with the FTC, you can't really win, you don't really lose unless you've been *very* bad.
I can certainly understand the desire to fight in court to clear their names, but from a purely business standpoint, I think its a waste of time and money.

I haven't heard any statements from the third company fighting it in court anywhere yet, AdultPaymaster.
