Well, if you got it from there then you are in violation of their terms anyway:

(from their user agreement)

You may NOT :

use Content in any logo or part of any trademark;

under any circumstances, use Content in connection with any pornographic, obscene, immoral, or illegal materials.


They also state in their user agreement that they could have screwed up and that if the images are actually infringing a copyright that they will take it down and offer a process for recourse. And I am not a lawyer but my reading of the user agreement does NOT indemnify you from being taken to court (it does indemnify them) if you suffer damages from uasing an image from their site.

So, it seems to me that you have been notified that you are violating a copyright and as a good webmaster you should remove the image from use until you can smooth this out with Nick.

Firstly, the designer Nick paid for an 'exclusive' image, lifted it from clipart, removed a finger, and claimed it as his own (and charged Nick accordingly).

Secondly, he may well have done the original artwork for Nick, then added the finger, and sold it to clipart, either as an exclusive or not.

Either way, LiftNw8 is using the image unlawfully...and it's possible Nick was ripped off.
