Origins
Decisions such as Roe vs. Wade, and more recently, Lawrence vs. Texas and Goodridge vs. Dept. of Public Health have led to the constant regurgitation of the idea that liberal, activist judges are trying to impose their outrageous ideas on an unwilling populace. Therefore, voters must support Republicans because Republicans will stop these judges from force their beliefs on the public.
Talking Points
The most liberal state in America, the state of Ted Kennedy, is trying to force people to destroy marriage!
We have to stop judicial activism. You don't have a problem with THIS law...but what about the next one? When does this stop? If we don't pass the Federal Marriage Amendment, judges will force Alabama and South Dakota and other moral states to accept same-sex marriage! If we don't pass the Let's Stop Liberal Judges Amendment, your very existence is under attack!

- If Republicans and conservatives are so concerned about activist judges, why are many of Bush's nominees extremely outspoken in their contempt for current laws, to the point where some, such as Bill Pryor[1], have filed briefs calling for the removal of everything from the Americans with Disabilities Act to the Clean Water Act? Why are so many Republicans desperate to defend Roy Moore, who put his own personal feelings above state and federal law in the 10 Commandments case? Why are so many activists desperate to appoint Supreme Court justices for the sole purpose of overturning Roe vs. Wade?
- If we're going to blame a party for the scourge of liberal activist judges, why shouldn't we blame the Republicans? 6 out of the 7 judges on the Massachusetts Supreme Court were appointed by Republican governors. Anthony Kennedy, Sandra Day O'Connor, and David Souter, all appointed by George HW Bush or conservative hero Ronald Reagan, have routinely upheld abortion laws, and all voted in the majority on Lawrence vs. Texas.
- How does President Bush simultaneously praise[2] activist judges on Brown vs. Board of Education while condemning them for Goodridge vs. Dept. of Public Health? Is judicial activism only laudable when he says so? How do Republicans feel about the legalization of birth control and interracial marriage? Do they give those a pass like they do with Brown vs. Education? Did he condemn them when their 5-4 vote got him into the White House?
Analysis
While nothing will stop Republican politicians from using this for their own selfish ends, the further education of voters on the hypocrisy of the GOP and on the Republican justices who have been behind some of the most controversial civil rights legislation in the past 50 years will render this argument as hollow as many of their other memes about liberals, taxes, and the war on terra.
