Acacia Technologies Acquires Redirection Patent from LodgeNet Entertainment

NEWPORT BEACH, Calif. & SIOUX FALLS, S.D.--(BUSINESS WIRE)--July 21, 2004--Acacia Research Corporation (Nasdaq:ACTG - News; Nasdaq:CBMX - News) announced today that its Acacia Technologies Group has acquired U.S. Patent No. 6,226,677 from LodgeNet Entertainment Corporation (Nasdaq:LNET - News).

The newly acquired patent has several potential licensing opportunities, including DSL registrations, wireless "hotspots", and hotel high-speed Internet access (HSIA). The patent covers technology and methods for redirecting users to a login page when accessing the Internet.

Acacia expects to launch a licensing and enforcement program for the redirection patent in the third quarter, and will continue to separately license its Digital Media Transmission (DMTŪ) patent portfolio.

The Patent Purchase Agreement with LodgeNet includes terms by which the companies will divide future revenue received by Acacia from licensing the patent. If certain revenue benchmarks are not reached over the next several years, LodgeNet retains the right to repurchase the patent. Under the Agreement, LodgeNet and its customers are also fully licensed under the patent to conduct LodgeNet's Internet-related businesses.

"We previously announced our intent to acquire additional patented technologies," said Acacia Chairman and CEO, Paul Ryan. "Our goal is to expand revenue generating opportunities by leveraging the expertise of our in-house engineering and licensing teams."

"Our technology development group has created significant intellectual property over the years," said Scott C. Petersen, President and Chief Executive Officer of LodgeNet. "We believe this relationship with Acacia will allow our company to financially benefit from that technology beyond the scope of our core business."

The acquisition of this patent adds to the Acacia patent portfolio, which includes pioneering patents relating to its DMTŪ technology for transmitting and receiving digital audio and video content via various means, including the Internet, cable television, satellite television, fiber-optic, and wireless systems. Acacia has entered into 156 license agreements for its DMTŪ technology for cable TV services, corporate websites, e-learning, hotel on-demand TV services, and online entertainment, movies, music, news, and sports.

Funny how that was a WC3 composium thing with the META URL spec back around '94.

Now just waiting for BT to come sue everyone who has a hyperlink on a page. :(

Wasn't Lodgenet one of the ones who signed agreements with Acacia?
If so, now we know what their sweetheart deal was....:-)

Once again, they have obtained a marginal patent, one that would appear to be able to be defeated because there is little new in the patent. Redirection is one of the basic functions defined in the http protocol, and has been a part of webservers almost since day 1.

I am sure they will go after all the hotspot wireless places and try to make them pay.

This will be entertaining.

I agree with Alex... it seems pretty clear that there only real business model is to fool investors into thinking that Rob Berman, Head Counsel and ACTG principle is doing them a favor while he screws them at $500 plus an hour and has nothing but a losing track record.

I can understand the DMT patent and them going for it. I don't agree with it but as a business move, i understand it. Seeing how it all played out and understanding a little more about patent law and the obstacles they face, this patent just seems silly and easily beatable.

Their stockholders are like people who just lost at the casino, and are now trying to win the money they lost back by throwing more money on the table - good thing is that they will convince each other that the stock is much more worth, and by doing so, they will spend more money buying up stocks, before the next round of bad news, when they will loose all of the talked up value + money they invested :-)

Acacia is not worth more than its current liquidation value - including their patents... how much would a company like IBM be willing to buy the acacia patents for? Iīm guessing it is alot lower than the value an average acacia stockholder think its worth - lottery tickets only have a imaginary value until the drawing takes place, after that everyone knows their value... Acacia should pay gaming tax to the goverment, since their stock is nothing more than a lottery ticket for the naive investor.

I have a simple solution to the attorney problem I see in this country: Loser Pays. That would eliminate about 50% of the lawsuits out there. And most of the frivolous ones

Heh - someone has had a "Ask Order" for $5.90/2000 stocks for the last few days... maybe its Ryan and Co. trying too convince the market that they are all wrong about the current $3.00-3.30 level - or maybe its an investor who killed himself, when the stock dropped like a rock, and therefore never logged out or adjusted the asking price :rolleyes:

The problem with this is if a poor person who has been wronged can't afford a decent attorney, they will never even bring the case to trial i the first place just because of that fact. It would set a precedent that if you can't afford a decent attorney, you may as well not even try....
