Apparently Hooper is do desperate to get more tool bars installed, he is trying to do it to webmasters from his progam.

Here is a screen cap. Notice how he is trying to pass it off as a windows media update? I wonder what microsoft would think about that?

That's a lawsuit waiting to happen. I remember a while ago, MS sued a bunch of spammers for sending out emails with a microsoft.com return address. This is worse, in my opinion.

Wiseman, nice post but you are wrong.

Gonzo broke down Hooper toolbar with Kevin Mitnick ( maybe you recognize the name) and it was evaluated to be scumware.


Does your toolbar check back to your servers?
Can it be updated with new features on the fly?
Why do you try and trick people into thinking it is a microsoft windows media update?
The screen cap above fake? or were you guys trying to install on webmaster computers? ( fake media update)


Hypothetically, even if your toolbar is not stealing clicks and viewers, it certainly could turn into that pretty quickly and on the fly.

So when you hit a certain amount of installs you flip a swtich and start playing games then.

As far as laws, I have seen Utah's new one. You may want to start geofiltering people from Utah out, because you are breaking the law there.

Other states will follow suit.

Write an autodownloading toolbar remover.

Time to go to war. Take the traffic, don't pay for it, and remove the toolbars at the same time.

The only saving grace is the government moves very slow and doesn't understand the internet.

However, you make a good point. Spam is now so out of control that email is virtually unusable and people are actually wanting the government to get involved and do something about it. And billing has been raped so hard that we're clinging to the ability to sell a user a membership via credit card by the skin of our teeth.

Yet, we as an industry still haven't learned the lesson as we still tolerate fuckers who push the envelope too far instead of sending them out of town tied to the back of the same mule we'd send a kiddie porn peddler out on.

The reality is, if the federal gov't does not step in, or some major companies start sueing ( microsoft) it may become a neccessity to create andd distribute scumware just to stay in busniess.

DirectNIC gets at least a dozen e-mail a day dealing with scumware, people are getting redirected all the time.

It is going to be a major issue. I think it is much more invasive then spam and pop-ups ever were.

At the end of the day, the cats out of the bag. As with most things, once the fools at the bottom of the food chain start doing something, the money's all gone out of it.

Look at spam. I know how many people bought processor lists and everything else to start spamming once the word got out about how much you could make and times started getting tight in other revenue areas.

Look at crazy cross sells. Once you give them to everyone, it's all over. I don't mean decent ones that a surfer might actually enjoy, I mean people selling shit that comes with a 5%+ chargeback rate.

Look at tgps, mgps, circle jerks, blind links, pop ups, popunders, exit consoles and anything else that ever made money to the first few people who were doing it big and doing it right.

Spyware's been around for at least 3+ years that I know of, and when it was just a few people experimenting with it, it wasn't all that bad. Now that everyone and their brother is doing it, I figure that a good 30% of the traffic out there is being diverted to other places, and the battle is between the people writing the programs, to try and keep theirs the dominant one.

Toss a few fools into the mix that have no clue what they are doing and you end up with a total clusterfuck and boxes that don't work, governments stepping in and a bunch of frustrated surfers. The reality of it is that if Microsoft themselves do not step up the pace against all the crap out there, they will lose market share to other companies at a rate that will become alarming when it picks up speed.

As a legitimate business person today, I'd be looking at DRM for my content and keeping an eye on my processing. The first one is what, imo, might actually create a situation where people can make money again. The second one is of course the Achilles heel in any enterprise and with all the crap going on right now with investigations here, banks pulling out there and the like, it's going to get better before it gets worse.

Of course every product I deal with these days is either a DRM or a processing related situation, and my best consulting customers are the ones who are looking at the future from this angle...

Hooper isn't the only one doing spyware. Alot of what he does is just as bad as other peoples practice. Quite a few mailers hit 10 year olds with Tranny spam every day.


But when you wan't to send traffic to these types, remember, they are looking to fuck people hard, so if you are a webmaster, think about if you'd really be on the un-fucked list.

Hooper is one amoung many. Lot of deep pockets. Since the Feds are taking too long to regulate, it maybe time for the sharks to get involved.

Once they smell blood, it could get ugly. Combining Class Action with RICO could be devistating.

Best thing about this is an enterprising person could raise an army of sharks and not have to put out any $$$. Sometimes contingency can work.

There could be money to be made. Unfortunately, much like spyware, toolbars come in many shapes and flavors and whoever does a tool for them has to manage to keep up with them (Like the viruses and the antiviruses).

Known toolbars would not be that hard to write against.

In response to the rest of the thread, unfortunately, it is hard to get action taken when Microsoft and AOL are two of the loudest voices AGAINST spyware and toolbar legislation. They use the technology that makes these things possible extensively throughout their products and tahy are not, anytime soon change that direction.

Vick, there is money in making a "browser help object" manager, something that can pop up before a new BHO is installed and say "hey, do you want to install what is probably a piece of shit spyware?" Something that checks things like the hosts file, the DNS servers being used, etc, and points on when they are being changed from the originals to keep people on the straight and narrow.

I think there might also be a market in creating false files that make the spyware people think their shit is already installed, so they won't install it again.

Looking at how fast (in political terms) the US house and senate are coming to terms with this, I think this has made top of mind awareness all over, which makes it a very short lived situation.
