hey its a bit early for you to become Mr "I told you So" isn't it when you don't know what happenned?l a lot of charges can sound bad but they get dropped or wittled down to lesser charges and a charge that sounds serious like "assault" at least I know in england can be for as little as touching someone so it could be nothing.

People can make shit up about minor incidents and turn them into big charges that later get thrown out when the prosecutors look at it or the accuser realises they have to actually go to court and lie or exagerate things.

Assault alone is when a person suffers "apprehension of imminent unpermitted harmful or offensive touching."

All the elements (apprehension, imminent, inpermitted, harmful or offensive) must be met....

If someone says "I'm going to bash in your face in two weeks", the threat lacks the "imminent" component.

If someone sneaks up behind you and smacks you on the head, you lack the apprehension factor because you didn't see it coming.

In BDSM, the "harmful or offensive" touching is permitted, so no assault.

The actual touching is Battery, no matter how slight. A shove or slap can be a battery.

Aggravated Assault is a threat of violence with a weapon of some sort. Guns, knives, pool cues or a broken bottle all count.

So.........based on this, you could threaten to hit someone with a pool cue, and then shove them, and you would have aggravated assault and battery.

Too True.. I got busted in new Orleans.. and the Charges were Commercial Trespass, Drunk and Disorderly and the best one .. Fighting with police officers.. all sounds really bad.. but I had my day in court with the Judge "Mad Max" and you know what.. it was thrown out of court.

The whole thing with JoeE might be something real stupid and petty..
