Club Jenna has officially joined the fight against Acacia.

In the beginning when first sued by Acacia (back on Dec 18th, 2003), they were considering settling, looking at their business and deciding what was the best decision to make (especially since companies like Hustler had already settled).

Thanks to the brilliant marketing tactics by Acacia in trying to convince Club Jenna to settle, Club Jenna decided to make it a BUSINESS DECISION, to not settle, and instead, to fight by joining the defense group.

A quote from Jenna from the AVN article:

"Acacia is making a blatant attempt to target the adult industry in its effort to extract unwarranted fees for alleged infringement of its patents," Jameson said. "I don’t think people realize the implications of what Acacia is trying to do. If Acacia succeeds in intimidating adult site owners, they will move to mainstream sites and begin charging fees that will have to be passed on to everyone who uses the Internet."

Acacia is partners with all the companies that licensed the patent, since the license is based on gross revenue (percentages varying from sweetheart deals to 2-4%). When the licensees make more money, Acacia makes more money, and that money does go into legal fund. Acacia is burning alot of money in legal fees as well as the defendants.

The difference is that part of the legal fees by Acacia are being funded by the $2M in annualized license revenue, whereas the current 11+ defendants are burning the profits from their companies to fund the defense.

You would think that those that settled would want to help the defendants privately, but I heard a rumour that some webmasters feel that Acacia isn't pushing hard enough on their competition.

Patents can be used as an anti-competitive measure. It is very conceivable that anyone who settled with Acacia, could be doing so for a BUSINESS DECISION to financially cripple their competitors.

Acacia sued 7 companies on Dec 18, 2003.


Orgasm.com - no word on what they are doing about it

Club Jenna - joined the defense group

Webpower - hired an attorney to look into it (haven't joined the defense group)

Cybernet Ventures (Adult Check) - joined the defense group

Global AVS (Pro Adult) - joined the defense group

ICS (Adult. com / GFY) no word on what they are doing about it

National A-1 - joined the defense group
