Very disturbing.

This is the problem with attorneys and lawsuits, everyone just folds and sees it as part of business.

I hate attorneys with a passion, and those who abuse the legal system to bully others. We need major tort & patent reform in this country before they kill business!!

There is a huge horde of attorneys scoping out every company that has deep pockets.... looking to rape and pilidge - or at least shake down a littl with some nusence lawsuits.

There are a lot of lawyers troiling around for big pay days. I am sure you have seen your fair share of TV commercials, bill boards, etc....

The tort system in the US has become like a lottery....

The sad thing is, it is ALL of us who are paying the bill!

Nick, exactly what they want you to think. I think it is important to note that both of these "blockbuster" deals are "terms not disclosed"... which translates roughly to "We made a sweetheart deal to be able to use their name"...

If the license fee gets small enough, it is easy to figure that the reward (saved back payments for all the time from 1991 onward) @2% is less than the expense of signing (sweetheart deal, $0 for any thing before signing, fixed rate soft payment for 7 years, etc). Risk of multi millions compared to a much lower expense spread over 7 years, with the chance of a reprieve if the copyright is struck down in that time frame.

Really, it is simple math. Acacia could have avoided almost all legal if they had come to the table with a signifcantly smaller license fee (say .25%?)... but they are lawyers, and they like to run up billable hours.

Alex it pains me to say, but you are right on the money when it comes to sweetheart deals with big names.

Alex,

Contrary to popular belief I am not a retard and am aware that this is what they want. ;-)))

In a previous thread I stated ,if it was me ,and I was offered a sweetheart deal , I'd rip their arms off to take it.

But I have never claimed to be an industry leader , a roll model , or a saviour.

I'm a businessman.

My question remains unchanged.

Who is left fighting the claim?

Those who have not been offered sweetheart deals?

When a sponsor program licenses the patent, Acacia can't go after an affiliate for the same infringement...

This is not the issue that held them up... it was Playboy negotiating the lowest possible fee to pay, that would be less then them paying legal expenses to fight in court.

"Yet" should not be read into.. we don't believe they can win. It is all numbers.. AEBN and all the other companies fighting will fight for as long as it is good business to do so. If it ever gets to the point it is a loosing proposition we will take that into consideration.

If you ever want to know who is still in the fight.. this site should be up to date.

OK ,for the record, I totally believe this patent to be ass.

But lets have a reality check...

A corporations duty is to its shareholders

it was Playboy negotiating the lowest possible fee to pay, that would be less then them paying legal expenses to fight in court.

If I was a shareholder I'd be pleased that they took this action.

So you pay a small fee and then wait for the potential "blue sky" that the patent gets struck.

Sounds logical to me.
