After testimony from her next door neighbor that Jackie Marin Barkley has lived next door to her for the past 20 years ...that the woman was a habitual name dropper, rude and obsessive compulsive....
The judge concluded that she had been served properly as witnessed by her signature on the court servce [how do you do that when you live in Indiana/Texas for the past 2 years?] and awarded Kevin Mitnick and Darci Wood a default judgement for 5,000 dollars. Confucy has 30 days to pay up.

The charges of perjury are now being persued by the DA's office.

Just for fun, let's say that Confucy isn't Jackie and actually IS Kimberley Tracey and has lived in Indiana for the last 100 years. So.....why didn't Jackie appear in court since "she" was subpoenaed? :P After all, the REAL Jackie would love to take the opportunity to clear up once and for all that she's not Confucy - right?

Sorry, Sarettah, they would allow my laptop and there wasn't any wi-fi available.

As Gonzo told you earlier, we received a judgment after presenting our case to the judge. It was not an automatic default judgment because she didn't show.

She did write a letter to the court (penned by Jacqueline Barley-Marian under the penalty of perjury) that we viewed in the file yesterday morning. She attempted to poison the court with this terrible letter, and attached the press release from Kevin's conviction. The address was a mail drop in Indiana, and the signature was not hers. We had pulled a certified copy of a file from a $20K judgment she has against her with United Merchants Association. Inside the file, was a credit application filled out and signed by Barley.

We sent this credit application and the crazy FCC letter she wrote to a well-known handwriting expert, and she said preliminarily it looked like they were made by the same person, but she could be sure once she had more handwriting samples ordered by the court.

In the letter, she perjured herself by saying that she has lived in Indiana for the past two years, and is not a resident of California. The judge found that she was properly served, after we told him that one of our subpoenaed witnesses was a neighbor who had lived next to her for twenty years. The neighbor stated to us that the only person living in the apartment is Jacqueline Barley-Marian, she saw her just a couple of weeks ago when the neighbor was served, and that she still currently lives there. This neighbor even drove Jackie to her husband's funeral a couple of years ago.

The judge found that the statements made on Oprano constituted libel and qualified as publication. We also showed the posts where she mocked the entire court process and said she would continue her actions, no matter what happened in this court. We also showed the court that she is using multiple identities and has committed identity fraud.

We had forgotten to file a paper, and returned to the court 15 minutes later, where the case was reopened to add the costs to the judgment order. We were walking out, and were approached by a gentleman, that wanted more information about the details of the fraud. I think the DA is going to be very interested in this. I wonder who in Indiana helped her perpetrate this fraud on the courts.

She brought this all on herself. She begged and pleaded for an opportunity to tell her side, and we gave it to her. She didn't show and attempted to create an elaborate scenario to distract the courts, and in the process perjured herself. I think it is clear who was telling the truth here all this time.

Jackie I would call yourself a lawyer (a good one).

I bet the insurance company with that $20k judgement would love to hear about the details of this and see the documentation where she claims she hasn't been living in California, but instead, in Indiana. Would probably help them collect and/or seize to settle the debt.

I was compelled to appear under subpoena today at this this hearing and I can say unequivocally that the statements made by Darci in a prior post are 100% accurate without any embellishment. I was not called to the bar however as the evidence was overwhelming already.

I did get a little wierded out by the "mystery man" who approached us in the hallway after the hearing. When he asked me what my involvment was, I said "witness". To what extent he asked? I motioned to some of my personal emails with Jackie and some letters from/to the FCC. He asked me for my name and motioned me to wait down the hallway. I went outside and smoked a cigarette until they (Kevin and Darci) came out of the Courthouse. Said my goodbyes and drove home.

Maybe more to follow from tohe other people who were there?

I'm wondering if the man who approached you guys was Federal (all of those different names and social security numbers) or perhaps with the insurance company that has the judgement... then again it might've just been a reporter. Who knows... where was Duck today?

Since it was proven by witness testimony that she *is* living in California and that she perjured herself with that fake letter sent from Indiana, I'm wondering why the judge didn't find her in contempt of court and have her picked up.

I was compelled to appear under subpoena today at this this hearing and I can say unequivocally that the statements made by Darci in a prior post are 100% accurate without any embellishment. I was not called to the bar however as the evidence was overwhelming already.

I did get a little wierded out by the "mystery man" who approached us in the hallway after the hearing. When he asked me what my involvment was, I said "witness". To what extent he asked? I motioned to some of my personal emails with Jackie and some letters from/to the FCC. He asked me for my name and motioned me to wait down the hallway. I went outside and smoked a cigarette until they (Kevin and Darci) came out of the Courthouse. Said my goodbyes and drove home.

Maybe more to follow from tohe other people who were there?
I'm wondering if the man who approached you guys was Federal (all of those different names and social security numbers) or perhaps with the insurance company that has the judgement... then again it might've just been a reporter. Who knows... where was Duck today?

Well, I'll say this. I'm a pretty imposing guy and I was intimdated by the manner in which he instructed me to "wait at the end of the hallway". You can tell when people are accustomed to givng orders or directions. You know, like a COP!

With respect to the matter before the judge today, this was a civil hearing. Any criminal activity resulting from her actions will more than likely be referred to the DA.

From my observations, the judge recognized that she (the Defendant) had committed acts of perjury, identity fraud and was contemptuous by not appearing for the matter before the court. The way in which he (the Judge) perused the doucments, formulated questions for the Plaintiff's, and, drew his conclusions (such as the service was proper, she had indeed committed acts of libel (in his own words "the plaintiff has satisfied the burden of proof for libel and tortious interference of business contacts") leads me to believe he found them credible to wit; the $5000 judgement was entered without hesitation.

I know this woman quite well (over ten years) and I have felt her sting on more than one occasion. I am sure she will do everything possible to frustrate what has taken place today. I must say this though.... If (and when) she does, It will cause her intense exposure within the court systems. At some point, I would ask myself this------Is it worth going to jail for?

Jackie (you know I don't use your true name unless I'm very serious), accept what has happened as a fait accompli and move on to better things than wasting away in this mish-mash of (you know the words) hate and discontent. This HAS become more serious than I thought it given the circumstances. The pile of evidence was HUGE. Boxes of it. At a glance, there are many smoking guns.
