OK, so the primaries in this were charged and pled guilty to "mailing obscene material", nothing new there, fairly rare perhaps, but not new.

But in this one, two other people were nailed for their role in "maintaining the web site"... Hmmmm...

This could be trouble coming down the pike..... maybe ?

Couple sentenced in Internet porn case

The Associated Press - BECKLEY, W.Va.

A federal judge has sentenced a Greenbrier County couple to prison in an Internet pornography case.

U.S. District Judge David Faber on Friday sentenced Michael J. Corbett to 18 months in prison, a $30,000 fine and three years of supervised release. He had pleaded guilty in August to one count of mailing obscene material.

Corbetts ex-wife, Sharon Bates, was sentenced to 13 months in prison, a $10,000 fine and three years of probation. She had pleaded guilty in August to a similar count.

The case involved a Web site through which the Corbett and Bates sold videotapes and digital video discs that depicted sexually explicit scenes of defecation and urination.


Faber also sentenced two other defendants, Joseph Tanner and Randall Rogers of Quitman, Ga., for their role in maintaining the Web site.

Tanner will spend 13 months in prison and pay a $20,000 fine, while Rogers was sentenced to three years probation. Faber cited both Rogers minor role in the crime and a physical condition that confines him to a wheelchair.

The future? this is so 1980s...

Let's see. The acts portrayed are likely to be considered obscene by most people. Not hard. They sold videos, and mailed them to customers, more than likely across state lines.

The website was maintained for the purposed of selling these videos.

This isn't an internet obscenity case, no matter how hard the writer of the story tries to make it that. If the material hadn't been sold as video tapes and DVDs, and not sold, the case would never have been in court, IMHO.

I hope the whole bunch of them become Bubba's bitch for the rest of their terms. Maybe they would catch on.

Alex, so true..... that is one reason I stopped doing CD Rom distribution. I had the Feds try to run a sting on me and get me to ship to Jacksonville Fla, in 1995. I knew better than to ship to Jacksonvile. But, I am sure that there were other areas that I didn't know about and could have gotten biten in the 'you know where!

That is one reason I get a little pissed everytime "Nogas famous zip code list comes up. It was not Nogas... it was from Greg Picconelli law firm - and was orginally made up for the leading video and CD rom publishers. They relied on that list to help keep them out of trouble.

There has been very little come from it where the internet is concernd (unless you were actually shipping product) but, in those days - you never knew where the next law suit was going to come from. I see that Acacia is after Python (who is not a Calfornia Co) but they say has enough ties there to sue them in Cal.) The same case could have been made by the feds for someone downloading pics from a website - in one of thos no - no areas. I think cases have been made along that vein - but they were people 'pushing the envelope.

No, 'the sky is not falling - but to me - it is better to error on the side of caution.

If your shipping via US Mail your a fool when it comes to adult CD Roms.

Dont think so? Ask the couple from amateuraction bbs. I think they are still in the federal pen.

US mail is federal.....not sure about the 'crossing state lines, or community standards thing - the ones trying the sting on me, didn't care how I shipped it - just so I shipped it. They just wanted to see it come into Jacksonville, I guess.
