As you know Shawn you have been a very naughty little boy of late

Im sure you know that there is quite a line up of lawyers waiting to speak to you and your company

Amongst those lawyers is OUR lawyer and YOU need to make every possible effort to speak to him ASAP

You have one week from today, after wich the gloves are off and we will be coming to ALL the boards with EVERYTHING

It could well be bigger than Acacia...On the Acacia note, I might have some good news, we are speaking with the company that holds the streaming patents that PRE DATE Acacias.

they are out there, we know who has them, just got to convince them to fight the good fight.

somebody was mentioning this on the pib board a while back.

i thought if that was true there would be people with trashbags and cinderblocks* looking for them, not just lawyers.

I remember someone coming on the Pond's flat board a couple months back saying that Sextracker was stealing traffic - I *think* the counter was launching pop-ups or something, can't remember exactly.
That's the only thing I can think of but it's probably got nothing to do with this.

But I gave up on scumware assholes long ago. They're all still around, still tricking users into installing their shit, and still making money. :(

Lee if you have your browser set to tell you when a site wants it to accept a cookie, you'll see that EVERY board tries to get you to accept them about 3 times. It's part of the damn software that remembers your LOGIN - you know, that convenient thing where you don't have to type your name every time you post? (Among other things.)

If you're going to try to slam someone for cookies, slam them all - don't be selective. It exposes your agenda.

I think cookies are great. I'm not sure why privacy advocates have a problem with ad companies tracking my habits and showing me targeted ads. I'd rather see an ad for a great merlot than for feminine leg shaving igia type shit.

Disabling cookies does everybody a dis-service.

The general fear with cookies is that websites can get together and compare databases.
Like if WebsiteA puts a cookie on your machine that has your name and password and you visit WebsiteB, where they have a cookie that has your name and phone number, then at one point WebsiteA and WebsiteB could get together and have your name, password, and phone number plus know the types of products you're interested in.

Prime candidate for selling to a telemarketing firm.

And so on, and so on. Sure, shit like this *is* done from time to time, but usually only by sites that are owned by the same company. They cross-reference their databases and come up with a complete profile on you.

The problem isn't the cookies really, the problem is the information you give the site for them to tuck away in their database.

Legitimate companies though use it for innocuous things like remembering the last time you visited the site so it can give you a little "welcome back" message, remembering your login to make it more convenient for you, holding an affiliate code so they can get credit for a purchase you make, etc etc.

If you don't like cookies, either turn them off or open up your browser's cache and delete the stupid things. It doesn't take an ad-aware program to delete cookies. They're not hidden.

If we were talking about adware or spyware then yes I probably dont have any recourse, this has nothing to do with those products, and we believe we have legal recourse and we are preapered to spend the money to test it. We are also preapred to test other legitimate avenues to hold Shawn and Sextracker SOLELY responsible and accountable for there actions.

As far as adware and spyware products go, i think when those products mature then everyone will be using them including webmasters:)

And I agree that there could be some interesting legal precedents at hand.

There's a question of who owns what is on a user's screen and who has the right to dictate what goes there.

Do you have the right to take a webmaster's traffic if he agreed to your T&C's giving you permission when he placed your code on his site?

Stepping further down than that, when the user clicks "ok" to T&C's to download some obnoxious spyware or whatever, does that give you the right to abuse them anyway you see fit?

I agree, could be bigger than Acacia. Rulings go the wrong way and the web could be rendered virtually useless as it becomes one big circle jerk with the poor surfer having no idea where he's going on the next click.

Not any way you see fit, but I do believe that if you spell out clearly in your EULA what the software will be doing and the user clicks OK, then they've got nothing to bitch about.

Just like the adult industry relies on that forgotten membership, the software folks rely on users not reading the EULA.

You could sneak "this software will blow up your computer and cause smoke to rise from the back of your CPU within 15 minutes of installation" into your EULA and no one would catch it until they had installed it on their third frigging machine...

The scoop is, that message boards can be amazing tools and in this particular situation they were so successful Sextracker are in contact with our lawyer and dealing with the problem.

My lawyer has since told me to shut the fuck up as they do...

We are hoping for a satisfactory resolution to the situation:)

Wish I could say more but lawyers are a pain in the neck when you dont need them and a pain in the pocket when you do need them, so I gotta take his advice at the moment:)

I have been known to disregaurd his advice on occaisions tho..
