The rash of fear tatics is upon us! A lot of you have said you cant afford to support IMPA et al...so does that mean your going to continue to support those companies that have rolled over on you and the rest of the industry for a "sweetheart" deal? Lets see hear what your thinking!

ahem, I have discussed this with Gonzo over ICQ and here is how i feel about it, agree disagree with me, it matters not, and you will see why.
I will not do/will not have any business with anyone who has settled with Acacia. This is a personal descision. I would point the fact out to anyone I know who is about to/thinking about doing business with these companies, that they have signed a deal with Acacia, and quite possibly
possibly given out personal information about their affiliates to the lawyers of Acacia. I would encourage someone to think about what that means to them personally, and what it says about the company they are considering doing business with. I would promote the use of a verifiable list of names that shows exactly who signed with Acacia, as this should be a matter of public record, and if they signed, they should not be ashamed/afraid to let the world know of their wise business descisions.

Now, as for this shit;...and serge actually has the balls to call GFY'ers morons.

I have read his posts there, and he says 80%, hows it feel to be in the majority of something?

I have been around 4 years, humm, not as long as some, but far longer than a lot of others. How I run my business has worked out pretty good so far and since your obviously clueless as to what I do/do not have a business interest in, speculating that I won't be around long makes you look......

If it weren't for the handing out of personal information which I'm against in nearly any situation, this wouldn't really be such an issue for me.

I can understand not having the money for an expensive patent lawyer and thinking it's either do this, or pay *huge* fines for past "infringement" over the years. Imagine the amateurs who are getting letters. I always tend to think of them first whenever something comes down that will "affect" the industry.
Some of these people really *do* feel that this is the best decision for their business, especially if it gets rid of past fines and if they can probably skip the $1500 too. And then if the patents are invalidated... cool. It's all over. But if the patents aren't, they're not facing a massive bill of thousands upon thousands of dollars that they don't have.
I can understand that.

I know the companies like CECash wouldn't have to worry about a few thousand dollars - but in the same vein, they'd have to worry about *millions* of dollars. Just as they're larger, the fines would be larger.
It's covering your ass, and that's one thing I always chant... CYA, baby.

However, I just cannot understand nor support giving out information that you've been entrusted with. The companies that did this - just how much info did they hand over? Their entire database, including social security numbers and EINs? The amounts that each webmaster has been paid? The exact number of videos/photo sets that each webmaster purchased? Or was it *only* names and addresses? Doesn't really matter to me - it's a breach of trust.
If they *did* hand over complete databases with SS#'s and EINs then I think that might violate some right to privacy somewhere - god I would hope so, at least.

I don't need any of the companies listed on my Acacia letter. I don't send traffic to them anyway for my own personal reasons.

It's the ones that *aren't* listed on the letter that have me wondering.

let me preface this with "I have not gotten a letter" so I am not in a position of taking any action of any kind yet, at least other than to throw what support and research I can....

But, I would encourage anyone that gets a letter that does NOT have a site with video to take action against the letter...

Not sure what kind is the most appropriate and that would be for each individual and their lawyer to decide....

The types of action I am thinking about are:

1. Report them to the postal authorities for utilizing the US mail for what most certainly looks/feels/sounds like extortion.

2. Contact the FTC and report them for unfair business practices.

3. Call them on the phone on your dime, make the call a nice long one, use the most expensive long distance provider you can find... Then ask them to reimburse you for the call, when they say no, hit them with an invoice for it, when they fail to pay it, file in small claims court against them....

Make them fight on as many different fronta against as many different people in as many different venues as possible....

There is every possibillity that this patent can/will be validated....

From what I am seeing, the easiest way to beat them will be to prove that the patent is unenforceable, not necessarilly invalid....

anyway, all of that is strictly in my humble opinion.......

As for boycotting sponsors.... I can see both sides of this.

If you're a sponsor who has been around a while, you're faced with the choice of lots of lawyer fees and a prolonged court battle. And if the ruling should go in favor of Acacia, you're liable for all of those years of past usage in addition to future payments. Meanwhile Acacia is offering to settle for what is comparitively peanuts. If you do not take their offer, you're taking a calculated risk of your company's future.

However, by caving and paying, you're basically paying off an extortionist.

Worse than that, you're feeding Acacia's cash flow and consequently their war chest to fight this in court. And the really scary thing is you're validating their business plan. There are tons of internet patents out there which are ripe to be treated in this same manner. For that reason, there really is some logic to a boycott.

I would much rather see sponsors taking whatever small percentage Acacia is willing to settle for and directing it to whatever group is best poised to collectively fight this in court be it IMPA or whoever. But it isn't realistic to expect something like that out of this industry, there isn't enough trust between each other, and everyone looks out for #1.

First: I've never even heard of father time.
Second: I haven't posted on netpond in a couple years at least.
Third: I don't have a static IP.
Fourth: I've only ever used one nick on the boards up until I got bored with it.
Fifth: even if anyone actually figured out who I was, it wouldn't really matter to most of them.. most probably never heard of me.
I keep minimal but longterm business contacts, i've never been to a show, and I generally keep a low profile without ruffling any feathers.

I am still undecided as well. I will know more later. However, I am not going out of my way to do more business with those who sold out. I would also be interested in doing MORE business with those who are still fighting.

The bottome line, business is business. If other companies cannot convert or make me the same amount of money as those who settle, it would be stupid to boycott them. However, if there are REAL alternatives, where I can not lose money.... I think I would lean towards not working with those who settled.

Serge, if you want to be technical, I'm not an 'employee' of anyone.
I'm and independent contractor, for which I receive non-employee compensation.

If you want to be even more technical, I've never even met anyone from the company in question. I don't go around propping up anyone, I will however try and defend those who I feel loyal to, and those I've had successful business relationships with. I wouldn't expect you to understand that.

And if you want to be even more technical than that, aside from not outright telling you who I am, I've made no actual effort to conceal my identity, and there's about 15 people that have either figured it out, or i've told.

I've even posted here as ''myself'.

What you might see as a bad business choice, I chose to balance my life between work and family, and thus I cut out the bulk of my other work, focusing on the people I'd been doing work for the longest. Again, a loyalty issue, something you know nothing about.

As far as dropping the sponsors, thankfully I don't push much traffic to any who have settled (yeah, OK, I don't push much traffic at ALL these days, but even less to those that settle). If there's proof of who showed their affiliate info, I WILL do everything I can to NEVER do any business with those companies. :angry:

I know for a fact that they do that at least with emails, as I've had to clean up an 8,400 webmaster email database and I've *seen* the tagging emails that people put in there. They use an alias catch-all account and do something like truthlightspeed@domain.com or truthmc@domain.com (mc for maxcash).
Apparently a lot of them take it further and "tag" their name/address info as well.

Also quite a few of the people stepping forward have only ever created *one* account for some reason or another, and that's the one that got the letter. Things like a wife helping out her husband by purchasing a certain set of content at Matrix while he was working on something, she never put her own name on anything else, and she's gotten the letter.

Sure the WHOIS info will give you a massive list, but these letters are going to specific names, companies, even misspellings that are completely unique to Matrix; so they only could've come from there.

But I have a clear error in my matrix information that is not present in the letter I received, if it were I probably wouldn't have even gotten the letter.

Like I said, I'd be more concerend with the balance of the settlers, and WHY they haven't been named.

I've signed up and plugged hundreds of programs, and although I have tagged many of the email addresses i've supplied, my letter contained no email address, just name, company, and address, which could have come from anywhere.

I've found my info in places I've never heard of, never been to, and places that there was no real reason for the info to even be there... but it was.

yep I worked as Sheet Rock Nailer, hung celling 6 days aweek 10 hours a day when I was 17 to 18 that was before they had Nail Guns. After 8 months of that I said Uncle Sam here I come.

I was responding in a literal sense, i'm sure everyone has had a shitty first job...
I did the dishwasher thing, the stocking grocery store shelves thing during high school... then worked in a paper mill for 6 years after HS.. then got into this biz.
