View Full Version : YEAH! I GOT MY ACACIA NOTICE!

MikeW

This has to be the funniest thing I've seen in a while.

1st - I get a letter addressed to "Mike No-last-name" at Wyldesites, Inc.
2nd - Telling me I'm in direct infringement of their patent, etc. ,etc.
3rd - Urges me to 'take advantage' of their introductory rates!!

hahahahaha!!!!

These morons have got to be kidding right? What is the criteria for even getting one of these letters? Just because you service the adult industry means you owe them money??

I guess they never even bothered to look at what exactly it is that I do?? Oh boy ..

you should file an extortion claim mike.

you'd likely win very quickly.

Extortion (Black's Law Dictionary - 6th Edition) is defined as:
"The obtaining of property from another induced by wrongful use of actual or threatened force, violence, or fear, or under color of official right."

I got mine today too.

Unfortunately, it is doubtful that the revenues generated by the vast pornodoggy empire would pay for the sugar for the acacia coffee service on a monthly basis.

And, uh, there is the little factor that I have no audio and no video anywhere on anything ...

I haven't checked my mailbox - now I'm wondering if I should. From this and some threads I've seen on GFY, it looks like they sent out another wave of packets.
Guess they're getting tired of having to post losses in their quarterly statements. Anyone else notice the timing of each swarm of packets as it relates to the release of quarterlies?

And again .. there's the issue - I dont stream anything to anyone!

Carrie, while I'm sure that they obtained my address from one of the programs that settled with them, the timing of the mailing is likely related to when they obtained the data and to the November 30th deadline for the "hassle-free" settlement. It provides them an opportunity to later say to a court, "See, we tried to be reasonable..."

I have to admit, though ... tying the mailing date to the release of quarterly statements, like speculating that there has been no hearing on this matter because a court clerk owns Acacia stock, is much more in line with the hysterical and ill-informed nature of most posts on most boards about the whole topic.

Not to spam other boards, but everyone receiving packets all at once is kinda important.
Alex gives a good response in this thread (http://www.greenguyandjim.com/board/showthread.php?s=986189d5f32027053a0f66dc3f649523&threadid=1765) to some folks that got theirs today, and there are so many new threads on GFY saying they got a packet today that I just did a one-week search for 'acacia' and came up with 85 (http://www.gofuckyourself.com/search.php?s=&action=showresults&searchid=357557&sortby=lastpost&sortorder=descending) freaking results. Lots of good reading in some of those.

PD, the quip about the clerk was a funny. *bonks you on the head*
Packet mailings in relation to quarterlies isn't, though. Think back over the dates when the board have previously been overrun with "I got my packet" threads.

They do send out singular packets constantly it seems, but there have been a few cases now of huge batches of packets going out and I swear it coincides with when we were talking about their quarterly earnings.

Now you've made me curious and I'll have to go digging and checking dates. Dangit! As if I didn't have enough to do... :P

Macromedia has the lawyers and the money to crush them in court. Same reason they haven't sued Microsoft or Real Networks - although they *claim* they haven't sued these companies because they want the people using the technology, not the ones who make the technology.

I don't have a lot of affiliate accounts and so far, unless CQ was grouped in the settlement with LFP, I don't think I have affiliate accounts with the folks that settled. It seems that folks have nailed it down that Matrix is the one giving out information to Acacia here:

matrix was asked to give out their customer lists. i dont think that was a secret.

acacia put the squeeze on them very hard very early and put a lot of financial resources into getting their lists.

Guess we'll see how good this agreement that Flynt affiliate income is exempt from this extortion is.

PD in order for that to work, I would think that Hustler would have to be your *only* sponsor.

Reading over some of those threads and in particular an exchange between MikeAI and Platinum Dave has me sitting here simply fucking stunned at the audacity, stupidity, and purely felonious activities that some people are willing to admit to on public boards.

Edit: Actually what has me even more stunned is that people continue to do business with them after shit like that has been admitted to. Why risk your business by aligning yourself with something like that? If that person will publically admit to doing that kind of thing, what makes you think he'd be more scrupulous and upstanding when it comes to business agreements between the two of you (or your companies)?
Ridiculous.

I responded to this on GFY also :awinky: but CE's an offshore company which settled. I would ASSume that if you did business in the states (i.e. have US customers, use US processing, etc.) then you'd be required to follow US laws. If not, then anyone could open up a shop offshore and start making every patented product known to man and sell it here.

Just talked with a webmaster. His "wife" (they are not legally married) got her Acacia letter today. All domains are in the "hubbies" name not hers. The name on the letter is not her legal name. She has it on no legal doucments. It is not listed on any registrar. Nor is her real ("maiden") name.

She did use that name *one single time* when she did hubbie a favor and filled out a sponsor-affiliate join form and she put that down as a "lark" for the contact name. So she knows it came from only one place, a sponsor who settled with Acacia and then swore up and down on the boards that they did not give their webmaster list out to them.

Surprise, surprise. Not.

Some of these cockholsters would sell out their own mama for the price of happy meal. So these developments are far from surprising.

I do wonder what their criteria is though. No reason to believe that they wouldn't have access not only to the addresses but probably exactly how much each affiliate has made, so it would become real easy to cherry pick the guys who have the most revenue.

I keep seeing folks say they can identify who it was by the name the packet came to. Which confuses me. Am I the only person in the world who puts accurate information into sponsor sign-up forms? It never even occurred to me to use different names or different addresses and such, because I wanted to make sure the checks would get to me and I'd be able to cash them!
About the only thing I "fudge" with sponsors is my phone number, because I *hate* getting phone calls.

Carrie,

Speaking for myself as all checks go to corp it doesn't matter what name
is put on there for contact person... I would imagine many folks are in
same boat I'm in regarding EIN vs SSN, corp vs non-corp status...
Hence the ability to use different (trackable) monikers on affiliate
proggies... hope that helps... :^)

It does, Mark. I was just thinking about the name on the check.

What would those who settled with Acacia do if Acacia said something like this?

"Your affiliates are protected now, because you signed up. So we need them listed to make sure we do not pursue them."

Acacia then have a list of webmasters and the knowledge that few of them work for one sponsor.

What we need is people who got the package to an address only know by sponsors to list those sponsors. It will not take a genius to see which names pop up consistently against who has settled. We may even find a few who have settled and kept quiet about it.

From what I've read, many people put a code at the end of the name of their company (ditto with emails) which allows them to track which companies are selling their info, spamming them, etc.

For instance, my company's name is Online Beach, Inc. Under this theory, I would sign up as Online Beach, Inc. 001 with Maxcash, Online Beach, Inc. 002 with CE, etc.

In hindsight, I wish I had been smart enough to do it. :(

Ah, I am loved afterall. Got my Acacia letter today! Woohoo! (Couldn't let PD upstage me.)

Interestingly it a) is not the way I'm signed up at ANY sponsor b) it would be where I was signed up at a content provider -- like Matrix Content c) they can still kiss my scrawny white ass ... while I lay a big smelly wet one in their faces.

Hmm, better yet, I think I'll do the same thing Brad did with Even's C&Ds. Hey, PornoDoggy, can I borrow your dog for about three minutes? :P

Before you let PD's doggy get to it, fax a copy of it over to the IMPA folks.

That makes you, PD, and me... just a matter of time before we can form an All Of 'Em anti-acacia organization and start taking donations! :cdance:

you should file an extortion claim mike.

you'd likely win very quickly.

Extortion (Black's Law Dictionary - 6th Edition) is defined as:
"The obtaining of property from another induced by wrongful use of actual or threatened force, violence, or fear, or under color of official right."
that is actually a pretty good idea, if you can afford to fund the suit . . . . I doubt you will find an attorney to take it on a contingency basis . . . . unless you found someone that recently passed the bar and was looking to make a name for them self.

...and I bet that your "noname" was given by one of the programs who settled.
I was thinking that too .. out of the 52 licenses they say they have issued, they referenced 6 companies by name in my letter .. and I've done work directly for 4 of them ...
it is a form letter, same six companies named in each, don't read unneccesary meaning into it

Makes it look more and more like they're just getting affiliate's names/contact info and not even taking the time to investigate the actual sites.
That's my thoughts. They're just sending out letters not even checking sites to see what is really going on or what type of site it is.

Are they hoping that with every letter they send out some moron will just right off the bat agree to send them cash?
I think it is more like the spammers that say "click here to be moved from our list" when in fact they are only attempting to verify the accuracy of the address.

JMHO, of course

Not only that, it also reminds me even more of the "Carder Scam Spam" ... Give us your credit card number and info, otherwise we'll put this $300 charge go through.

Maybe Acacia should start giving out prizes like Reader's Digest and American Publishing do! :P
