Hatch Takes Aim at Illegal Downloading

WASHINGTON - The chairman of the Senate Judiciary Committee said Tuesday he favors developing new technology to remotely destroy the computers of people who illegally download music from the Internet.

The surprise remarks by Sen. Orrin Hatch, R-Utah, during a hearing on copyright abuses represent a dramatic escalation in the frustrating battle by industry executives and lawmakers in Washington against illegal music downloads.

During a discussion on methods to frustrate computer users who illegally exchange music and movie files over the Internet, Hatch asked technology executives about ways to damage computers involved in such file trading. Legal experts have said any such attack would violate federal anti-hacking laws.

"No one is interested in destroying anyone's computer," replied Randy Saaf of MediaDefender Inc., a secretive Los Angeles company that builds technology to disrupt music downloads. One technique deliberately downloads pirated material very slowly so other users can't.

"I'm interested," Hatch interrupted. He said damaging someone's computer "may be the only way you can teach somebody about copyrights."

The senator acknowledged Congress would have to enact an exemption for copyright owners from liability for damaging computers. He endorsed technology that would twice warn a computer user about illegal online behavior, "then destroy their computer."

"If we can find some way to do this without destroying their machines, we'd be interested in hearing about that," Hatch said. "If that's the only way, then I'm all for destroying their machines. If you have a few hundred thousand of those, I think people would realize" the seriousness of their actions, he said.

"There's no excuse for anyone violating copyright laws," Hatch said.

Rep. Rick Boucher, D-Va., who has been active in copyright debates in Washington, urged Hatch to reconsider. Boucher described Hatch's role as chairman of the Judiciary Committee as "a very important position, so when Senator Hatch indicates his views with regard to a particular subject, we all take those views very seriously."

Some legal experts suggested Hatch's provocative remarks were more likely intended to compel technology and music executives to work faster toward ways to protect copyrights online than to signal forthcoming legislation.

"It's just the frustration of those who are looking at enforcing laws that are proving very hard to enforce," said Orin Kerr, a former Justice Department cybercrimes prosecutor and associate professor at George Washington University law school.

The entertainment industry has gradually escalated its fight against Internet file-traders, targeting the most egregious pirates with civil lawsuits. The Recording Industry Association of America recently won a federal court decision making it significantly easier to identify and track consumers - even those hiding behind aliases - using popular Internet file-sharing software.

Kerr predicted it was "extremely unlikely" for Congress to approve a hacking exemption for copyright owners, partly because of risks of collateral damage when innocent users might be wrongly targeted.

"It wouldn't work," Kerr said. "There's no way of limiting the damage."

Last year, Rep. Howard Berman, D-Calif., ignited a firestorm across the Internet over a proposal to give the entertainment industry new powers to disrupt downloads of pirated music and movies. It would have lifted civil and criminal penalties against entertainment companies for disabling, diverting or blocking the trading of pirated songs and movies on the Internet.

But Berman, ranking Democrat on the House Judiciary panel on the Internet and intellectual property, always has maintained that his proposal wouldn't permit hacker-style attacks by the industry on Internet users.

I cannot beleive someone in his posistion would advocate a posistion like this.

Could you imagine the chaos?

There are enough cockholsters out there sending viruses and such could you imagine if a virus would wipe out your computer rather then just replicating e-mails or worming?

We have enemy nations working hard to create software that would bring down the internet, bring down our power grid, our military computer infrastructure....

And we have this asshole Senator pushing for it....

Freaking ignorant cockholsters... these guys should not be allowed to make or pass laws they do not understand!!

Saretah, I think you keep confusing me with the liberals on the board who make excuses, and follow the democrat line no matter what they spout off.

I am an independant... I classify myself as a Libertarian. I think all professional politicians shuold be thrown from office. I dislike almost all politicians, or people who work for the gov't.... the beauraracy.

Hatch is a dingleberry... always has been....

Unlike those who are blinded by party affiliation or the quest of being a liberal, I have a brain which I use and pick and choose.

I doubt there is any President I would have agreed with ever 100% of the time... but I do respect President Bush... I am happy with most of his policies.... especially in those relating to foreign policy and National Security and war on Terror... Personally I wish he would do more...

But that will be in 2nd Term....

sarettah I hate professional politicans.... I think we need to look into getting back to where being a politican was a duty to serve, but the best and the brightest.

Who would take time away from their careers, work for 4-10 years helping out the Nation or their State, then go back to their careers or retire on the farm or whatever.

Politician should not be a career opportunity....

This is on all levels, local, state and federal....

Mike,

I thought you were a Republican. You are moving towards the middle?Nothing wrong with that. Just asking ;-)

I don't know if Hatch is an idiot but what he is saying is idiotic.

Colin I am a registered Republican, but that is because to vote in Primaries in La I had to be one or the other....

My opinions have always been Libertarian... I would hardly call them in the middle...

I am for less gov't in general, states rights, strong national defense/foreign policy, homeland security, free trade, low taxs, gov't out of peoples personal lives.....

Not to complicated... Republicans are right on some of the issues.... some they are not.

In general no professional politican is for LESS gov't.... which is why they need to go!

Mikey, mikey, mikey ... I thik Saratah was calling a spade a spade. The rhetoric you regurgitated in the above post proves that while you may not want to admit to being a Republican when it is embarassing to you, you are at the very least a fellow traveller, or one of those who has too much pride in what he really is to admit it.

That's okay - when I was younger, well into my late 30s, I issued countless (and meaningless) denials that I was a Democrat too. Free your soul - toss aisde the charade of independence and embrace your Republican-ness - unless of course, your true beliefs make them too far to the left too ...

Mike,

I have thought of a classification for your political beliefs; "Not Liberal".

Colin,

Actually all politics are too limited and they are inclined to overestimate grossly... Do you remember that hysteria regarding the "problem 2000". I always knew that 90% of this "problem" just did not exist. However many and many millions of dollars have been spend to eliminate it. I.e. that money was simply stolen ;) Here is a similar situation when some stupid politician is talking about the things he has no idea about...

Doesnt have to be done over the internet. XP most likely already has the ability built in to force a format c if you cross the copyright line.

OK. Dumb non-techie question: I keep hearing/reading all these things about XP not working on different computers, you have to have the original CD, blah, blah, blah.

My kid's got XP Pro that he downloaded free from who knows where, it's been running fine for months, and I haven't seen any MS-type folks hiding out in the woods. What gives?

Who said that you have to use Windows to download the MP3 files or anything else? Just use Linux - it's FREE  Do you think anybody will be able to destroy tour computer remotely in that case?..

Linux will never win.

cyberxxx
06-19-2003, 09:55 AM
There is no question which OS win (MacOS, Linux, FreeBSD, Windows or any other). The question is: if it is possible to destroy ANY remote computer via Internet. Is that really possible without binding to some specific operating system??? So there could be only two answers: "yes" and "no". Otherwise the question will be: "which operating system should we use in order to avoid the data destruction".

Thus if M$ will add some special mechanism allowing to destroy their system remotely, we will have to use another OS.

As far as I said earlier, Hatch is just a limited person who have no idea on what he is talking about... Perhaps he would like to hire me as an adviser :agrin:
