Passionately written from the standpoint of a frightened webmaster. Shitty journalism though that is based on opinion and very biased "expert opinions".

Not to say that the JD wouldnt be happy to string up some pornographers, but to quote our attorney recently... you should be far more worried about patent litigation and copyright issues than about any obscenity prosescutions.

Even 25 attorneys (if they really would all be brought on for full time anti net porno attacks) is a tiny army to attack a million man/woman army of electronic porno, much of which is so stealthily clad in offshore corporations and more importantly would fall into gray areas of community standards.

My prediction? There will be obscenity prosecutions.. they will be for extreme sites, fake rape sites and mainstream companies like vivid and matrix (just examples) because they are visible and easy to contact.

I am not now, nor have I ever been a pornographer. :)

We need to stop and rea;ize that there are some basic truths involved here...

Yeah, Bush signed this bill; but Clinton signed the one before it.
No politician is going to stand up and say he is FOR porn, anymore than any politician is going to stand up and say that welfare, etc is buying votes or that he is against abortion.
There is something going on behind the scenes...everytime Bush seems ready to get tough with the Senate, some new news item pops up about his kids.

I am with you Hooper. I look around the landscape and realize that there have been very few successful obsceneity prosecutions. Even Seymore Butts got off for fisting.

The cat is out of the bag, and this will hamper prosecutors....

There is some content, and sites that will get hammered by the gov't, and I think prosecutions could be successful - but they are for content that is on the edge, if not clearly over it. ( I support the gov't in cracking down on this stuff, it hurts our industry)

I think we will see more spam lawsuits against pornographers then obscenity prosecutions.... I think there will be 2256 crackdowns, and others legitimate things the gov't will do to go after people. ( Which means you really should have your paperwork IN order)

Thing is it probably is, but it ain't the gov't doing it.... we are bringing it down ourselves, and VISA/MASTERCARD is helping!!

So anyone know of any cases of obscenity cases that stuck and were just ridiculous?

What are the community standards on the internet? Internet community? Community where you live? Community where your business is located? Community where your incorporation is? Community where your server is?
